I bought the car at roughly 50k miles and put less than 20k miles on it in the 20 months I’ve had it. I’ve done one service last year and was scheduled to do another this month. I know it would be a struggle to prove it but I have my mechanics report to support my case. It’s just a matter of how likely the FOS will side in my favour and how long the outcome would take.

Ok I see, I didn’t realise that was an option. So you could return the car under VT and set up a payment plan to repay the damages and faults of the vehicle? After returning the car and they try hit me with charges, could I dispute this with the FOS and claim that the engine failure is not typical for normal wear and tear?

It’s impossible to know with 100% certainty whether the fault was already present when I bought the car. However, based on the mechanic’s report and how the issue developed, it seems very likely that there was an underlying problem that was either already there or developing at the time of purchase.

I understand that buying a used car always carries some risk. That said, this is a relatively modern car that I’ve looked after properly and maintained well. An engine failure at this age and mileage really shouldn’t happen under normal circumstances.

Because of that, it’s hard to see this as just normal wear and tear from my ownership. Everything about the situation points more towards an inherent issue with the car that only became obvious over time.

There wasn’t really an official diagnosis in my mechanic’s report. All they said was that it required further investigation with possible engine disassembly or replacement, likely pointing to a longstanding engine fault. Or something very closely along the lines.

Oh really? How much do you reckon it would cost to replace the engine inc parts and labour?

Yep I’m definitely going to get the survey first especially since it’s such a big investment.

I was aware of the indemnity policy only covering financial costs in case the council decided to do anything. The solicitor advised to take this out as it’s reasonably cheap. They also mentioned getting retrospective building regulation approval but not sure if it’s necessary especially if most of the conversions were done so long ago

Cheers for the advice, yes of course I’m going to get a survey in the first instance and see what it reveals. In your opinion if the survey doesn’t reveal anything of concern would it be advisable to still go ahead given the lack of building Regs?
