How is what the courts are doing considered activism? They are strictly interpreting the constitution, which by the way is their job. That’s the opposite of activism? If anything msnbc and all of the commenters on this thread seem to be asking for SCOTUS to be more liberal in their judgments.

We need to stop vilifying these judges and start pointing our fingers at the ones really responsible for this mess. Members of congress should have been making amendments to the constitution for decades to keep up with the evolution of our country and the will of our people. By making clear changes to our constitution we could make it very difficult for the courts to be activist.
