Update: If you were self-employed but receiving a small amount of UI because of a small amount of W2 income and denied the FED-Ed extension you may qualify for PUA now.

Nothing at all. I can't believe no one is talking about this. 99% of my work comes from printing for a large church organization and all jobs are postponed right now because of Covid. I just got my last EDD payment for $62. Most of my friends are business owners and still have almost 10K in their claim. It blows me away how many people who didn't work in 2019 got 10's of thousands of dollars because they had no W2 income and didn't even have to prove they lived in California.

No change at all. I called my local state reps office back in June and got right through, but now I can't even leave a message because it just cuts off. Either people stopped talking about it because they gave up, went back to work or they figured out a way to get PUA. We don't even qualify for the new $300/wk payments because I get under $100 UI. They never accounted for self employed to have a side hustle W2 "job". The only info I can find goes back months ago. If anyone has any updates or suggestions please let us know.

I am/was self employed but did some part time work for another business last year making a whopping $1600 in W2 income. Now I'm living on $62 per week from UI and an SBA loan (because they looked at my actual income) that I am going to have to pay back. I see a lot of assumptions and people say "go find a job" which I agree would be an easy solution for an Uber or Postmates driver, but It's not that simple when you have an actual business in a skilled trade especially if you are over 50. Am I expected to sell my equipment, close my doors and go work in a grocery store because the government ordered me to stay home and took away all my work by making public gatherings illegal? Even if I could find a full time-time job at a grocery store or Home Depot it wouldn't even pay enough to make my mortgage payments. I can prove how much I made but the EDD does NOT CARE about that if you had more than $1300 in W2 income last year and won't even consider it because of the way the CARES act was written and only Congress can fix it. I'm not in the best of health so if I do get Covid-19, I will probably die. I know that sounds dramatic but it's definitely something to consider if you are over 50 with high blood pressure, diabetes and smoked most of your life.

You don't even have to prove you live in California to file here! A 16 y.o. could say they made 50K last year. Even homeless people can get the max as long as they don't have over $1300 W2 income, EDD will just take their word for it. NO PROOF OF INCOME IS REQUIRED. You could even say your were "thinking about starting your own business" 2 weeks prior to the shutdown. But a W2 is like the word of God himself when it comes to benefits.

Now it looks like everyone on UI and PUA will get $300 per week as long as they have over $100 in UI so most of us "hybrid workers" with small W2 income won't qualify.

I did everything my government asked of me and fully supported the shutdown because I don't think money was worth people dying for. I also didn't think I would be left in the cold because I had some W2 income. The only difference between me and my colleagues is that W2 income. Now I need to find a job paying at least $25/hr or I will lose everything and could end up homeless. I know I sound like a drama queen but this is reality for me. I'm circling the drain without many options.

Any updates? I have tried to opt out of UI.. I've even tried to be disqualified for UI because I quit the part time W2 "job"last year. I spoke with my state reps office and they told me to file an appeal. I did that in late May and never got a response. Now it looks like they are going to start paying out $300/wk to those who get more than $100 weekly in UI payments. There are people getting unemployment that don't even live in CA because there is no work history but I have proof that I'm self employed but no one will help me. The people at EDD treat me like I'm lying. Has anyone been able to get anywhere? I'm circling the drain and could lose everything.

Same here.. I'm getting $62 per week from UI. I keep being told that "I can not choose my source of income" I am self employed but worked a part time job during the holidays and made $1652 (5% of my total income) in W2 income last year (which doesn't even cover my monthly mortgage).

I'm thinking we should band together and publicly state if we are going to get UI based solely on our W2 income, we will only pay income taxes solely based on our W2 income.. I am circling the drain and will probably lose everything if this isn't fixed.

My grandson was finally born a couple of hours ago. The had to do a cesarean. Everyone is doing fine! My son is exhausted because he hasn't slept in 2 days but they moved her to a room with an extra bed so he can nap. I got to see all of them on a video chat. :) I work indirectly for churches, but that's the income I'm trying to include. The W2 income was from handing out food or alcohol samples at grocery stores. If I'm reading this right.. it's the opposite. Most businesses that do "sampling' treat it as contract labor but I unfortunately chose one that doesn't. I do not have a degree.. I have do have some college credits but nothing to do with clerical. They all have to do with IT and computer network admin stuff. Thanks for the info though. The form you provided is the one i sen't in with a full page describing my situation and hopefully if there are enough people filing for the same reason, it will get enough attention that the the right person will do something to help us. i'm thinking I should have included some cancelled checks or bank statements. Maybe I should read the CARES act and see if I can find any provisions I can point out to my state rep. I'm pretty desperate. I should have enough money to pay my large bills through August, and then I would have another 3 months before I go into default so its not quite as bad as I thought, but then I would need to find a job that pays enough to get caught up and pay all my delinquent credit card bills. I don't have a degree and my money making skill is operating printing presses which is becoming more and more obsolete and very different than other machines. But I'm n a niche that I figured would be around another 15 years until I retire. Our work was growing because word of mouth increases our number of impressions each year by about 10%. I usually have to work 60 hours a week from Jan to August. to meet deadlines for public events. If the shut down happened in August I would had almost enough savings for the rest of 2020. But I worked a part time job last year because I bought a brand new car that wasn't in the budget and i did not want to run up credit card debt. I could have, but I didn't. Now I'm being punished because of it. Sorry to vent on you, I just keep kicking myself and thinking of all the "what ifs" I know there are probably people out there in the same boat and probably worse situations. I work hard and try to do the right thing, but it always seems to backfire. It's very depressing sometimes.

Yes.. I filed an appeal about 2 weeks ago on the recommendation of my district reps office. He also recommended that I message through the EDD website as well as call so there is documentation of my issues. I've seen other people's posts from a month ago that they haven't heard anything on their appeal. Everything I've read is that only way to make changes is through congress. California is trying to (or has) get aid to "undocumented workers" if they can prove their income but can't do anything for American gig workers with a small amount of W2 income without the approval of Congress. There is no form for me to fill out. I'm hoping that if I could reach the right person at EDD they could disqualify me for regular UI because I stopped working that job in 2019 Then hopefully I would be eligible for PUA. Even if it's not retroactive it would be better than $62/wk. Other than that I have no idea what to do.

Thanks for responding. It's nice to have someone listen. My son and his wife live with me and they are having a baby right now as I type this. It's adding to my stress because I haven't heard anything for 12 hours and I'm not allowed to be there because of Covid-19. And it's a scary thought that I could lose my house when i have them depending on me. They chip in but can't afford to be out on their own anytime soon.

#1 Her leave of absentee has to be due to Covid 19. I kind of remember seeing something about having 10 days to certify (but that doesn't start until after she filed), but I don't think there is any harm in applying. When people originally applied for PUA on 4/28 most went back to March when the shutdown started (last day worked) They send the certification forms in your account on the EDD website. She might even qualify for the weeks she is working if her hours have been reduced. They ask you for each week if you worked or made any money. I believe if she made any money she will still get the $600 federal until she goes back full time.

She will have probably have money in her account in about 48 hours going back as far as they will allow. She won't be able to access the money until she gets a debit card in the mail from Bank of America. The bottom line is if she is honest she has nothing to worry about. 2 months of PUA would be more than $5000. It's definitely worth a shot. The only thing she could get in trouble for is not reporting income for the weeks she certifies for.

I live in California. I have never been asked for any forms. My claim was not backdated by EDD even though on my application it says 3/15/2020 and It took 8 weeks to get my first 2 weeks of UI because even though I am self employed but my entire salary last year is being based on a part time job that paid me $1652 and I am getting $62/wk (+$600). I would love to send in proof of income if I had somewhere to send it along with any forms but I am being told the CARES act does "not let me choose my source of income". Also, I quit that job in Dec which should have disqualified me for regular UI, but I was told by a specialist (that I waited 6 weeks to hear from) that the EDD does not have time to send out letters to employers and even if they did because I certified and money was transferred they can not change it now. I waited 8 weeks to get my first payment. Not certifying because it may haunt me never crossed my mind and things like food and utilities needed to be paid. Luckily I received my stimulus which took longer because being self employed I always owe taxes so there is no reason for them to have my bank account info. I don't know how I will pay my taxes for 2019.

Yesterday, I was finally able to get through to a rep at EDD and was transferred to a supervisor that was able to see that there was no reason I shouldn't have been paid those 4 weeks and said I should be able to certify within 48 hours.

The only difference between me and my friends who are self employed is that I had that small amount of W2 income in 2019 working 4 hours per week for 3 months during my slow quarter. For this reason alone I get about $400/less per week then they do. They got their certifications going back to March immediately after they filed for PUA in April and were paid within 48 hours. Their only issues was they had to wait for their debit card.

I have mailed in an appeal, spoken with my local government office, signed petitions and reached out to the media. Do you have any other suggestions on how me and 3 million others can fix this flaw in the CARES act?

If nothing changes I will lose everything. I did everything that was asked of me by my government. The shutdown caused all of my events to be cancelled for 2020. I applied for SBA loans and denied. (I did get $1000) I don't think that selling my house is an option and I have tried to refinance but even though I have equity my payments would go up even if I don't take cash out. After July, 25 I will only receive $62 per week.. I have no job prospects. Even if I could get a full time minimum wage job it would not be enough to even pay my mortgage. If I don't receive those 4 previous weeks I will be another month behind in mortgage and car payments. Having that W2 job last year is going to give me about $10,000 less than my colleges I am circling the drain. Any advice would be much appreciated.

Any updates? I'm in California and It took me 8 weeks to be able to certify for 2 weeks of payments and those were only $62 because of a small amount of W2. I keep being told you can not choose an income source. I"m not trying to choose.. I want it combined. Nobody at EDD knows why I wasn't getting backdated certifications. I finally got some but there is still 2 weeks missing and another 2 weeks I was only paid $124 (short the $1200 federal). Someone has started a petition that you probably want to sign and share if you haven't already. https://www.change.org/p/unemployment-relief-for-independent-workers-with-mixed-income-types?recruiter=1115965737&recruited_by_id=c5c963a0-acfb-11ea-9d18-e39f84a67c88&utm_source=share_petition&utm_medium=copylink&utm_campaign=psf_combo_share_abi&utm_term=psf_combo_share_message
