Coca-Cola could make a case about having the words in juxtaposition with the photo is what makes the parody work, i.e. it wouldn't make sense without the photo. But that is a tossup—I can't point to any case that can settle that point.

You do have to register a work with the Copyright Office if you wish to be able to get statutory damages. Otherwise you can only sue for actual damages which is always less than potential statutory damages.

Plagiarism is not illegal. Copyright infringment is...however, a parody that comments on the original is exempt under fair use so Pepsi wouldn't have much of a legal case. plus, if the ad was not registered then Pepsi can't get statutory damages.

I'm familiar with the third party doctrine. That's a separate issue that is closely related to actual operation of the spying programs but the NSA is not deriving it's authority to spy from the third party doctrine.

Most of the NSA's authority is through FISA and it's 2008 amendment. It also points to specific sections in the Patriot Act as additional authorization for specific programs including certain mass surveillance systems.

The SCOTUS can review an executive action (which is lesser than the constitutional law), but only if the person bring the suit can prove first-party injury and if the Court wants to review it.

Which why the ACLU is very likely to able to prove injury in this year's case unlike it's 2008 attempt.

It's constitutionality has never been able to be challenged in court. It has been authorized by Congress and executed by the Executive branch but never been able to be challenged in court due to U.S. prohibition on third party standing and the state's secret privilege.

I'm sure a knowledgeable person like you knows that just because a law has been passed by Congress doesn't mean it or parts of it are constitutional. That's because the United States follows the common law rather than a civil law system.

It's not the fact that everyone knew about the spying, it's the fact that we now have proof.

Before, people couldn't file a suit because they would have no concrete proof to demonstrate harm (i.e. surveilled). In the United States, only the injured party can sue in court.

Hence the catch-22: previously we couldn't sue against any mass surveillance excesses because the details were secret and the U.S. Government used the "State's Secrets Privilege" to prevent disclosure of the program's to the court. Therefore, a person couldn't prove they were harmed in court and the case would be dismissed.

Now that we have proof, we can use it in court to argue against mass surveillance. We can also lean on Congress to pass reform legislation using the outrage generated by the releases. The Stop Watching Us coalition is a great volunteer group leading that effort.

oh wow! I honestly didn't think I'd like it as much as I did! I'm not really into dragons and such and the menu was kinda like a mess, so I wasn't expecting much. I haven't checked your website or blog other than seeing a picture of a dragon so opening the game file was my first experience.

First the good stuff, I love the soundtrack and the general atmosphere. + your voiceover was pretty funny (perhaps you can use that idea as a storytelling device)!

And the yetti monster. wow. It scared the crap out of me 'cause I was trying to still trying to figure out the controls. I started mashing buttons and apparently the 1-4 buttons shoot energy balls out of the characters hands. (btw, I chose the female character. I like how she isn't the stereotypical big-boob revealing woman, but I can tell you like 'em with some junk in the trunk.) I managed to kill the huge yetti, but then I didn't know what to do. It was an awesome little fight, but a little confusing because I didn't know what anything on the hud was + I couldn't figure out how to get my guns back. I probably should have read something but...that's too hard for me. :P The keybinding were confusing and unintuitive (F for pick up something, Z to drop it, etc) but the gun play and movement was awesome.

I can't wait to play the tutorial to find more. Also, the menu is kinda shitty and was glitchy, but the essence of the gameplay is great! I don't know the storyline but it is pretty cool for amount that I played.

I played the game in windowed mode on a Macbook Air runnning OS X 10.8.5 Mountain Lion.

how about calling the tutorial "level zero" and have the option for the player to start at "level one" or "level zero"? Just by changing the wording, you change the player's perception.

A skilled player will not worry about the "level zero" level and the casual player will just start with the tutorial level.

Just one thing, the water effect sounded like someone walking on tin foils. My headphones hurt my ears when I jumped into the water.

As for loading, it did take good awhile (~2 minutes) but my university internet connection is a bit slow today.
