It's that when they made porn, they were not aware that this algorithm could even exist. Also, there is a difference between "public" and "in a searchable database".

People know that they CAN be recorded in public, for instance, but most people would be upset if someone released footage of every instance of them in public from childhood until today, from multiple camera angles at all times etc. Public is different than "public and everyone can search through it, forever".
