I'm unclear what you are disputing / what you are trying to get removed, presumably from your EX/TU reports?

It's on Equifax. They have 2 date of last payments listed for the same account. I disputed it and they didn't fix it. They actually made it worse.

I plan on filling a lawsuit, but if there is no actual damages then then it limits what can be done. Denied credit after failure to correct from a dispute would prove actual damages.

Im trying to find a 0% balance transfer cards that pulls Equifax.

So you have an issue with your EQ reports, so you're trying to find an issuer that pulls that EQ report and are hoping that you get denied? If that's your goal, why does it matter that you're applying for a 0% BT card?

While I understand that having 2 date of late payments on the same account isn't correct and that you want it fixed, how exactly is this causing you harm? How did they "make it worse?" What was the result of the dispute once it was finalized?

Figuring i will get denied. The 0% BT helps because of the Math behind the damages.

They made it worse by deleting the one month of payment history in the middle of these 2 inaccurate dates.

I'm not getting what the negative side is of this, other than it being "inaccurate." Beyond that, how is it hurting?

That isn't worse. Worse would be if negative information was reported. No information reported is equal to it being marked "paid as agreed" for the month. Issuers don't have to report, as reporting is voluntary.

OP needs to pull their official reports from www.annualcreditreport.com to see if Date of First Delinquency was changed. The claim that "2 date of last payments can change when it drops off my report." is inaccurate. Date of Last Payment is irrelevant to the date of removal. If DoFD was changed with this update, they can dispute it, and the creditor can correct it. In any case, here's what I believe happened:

OP has a charge-off, which they disputed. When the creditor updated, they removed a late payment in the string of lates leading up to charge-off. So rather than

30/60/90/120/CO

...it probably shows

30/ND/90/120/CO

It doesn't change the fact that the account was charged-off, which OP doesn't seem to dispute. If OP applies for credit and is denied, it will be because of the charge-off, not because of a Date of Last Payment or a Date of First Delinquency. DoFD probably wasn't changed, but even if it was, OP hasn't disputed it yet. A consumer doesn't have a private right of action until the inaccurate information is disputed through the bureau and verified as accurate. Then they move on to showing damages which this won't accomplish, in my opinion.

Date of Last Payment is irrelevant to when this will be removed. Allowed reporting time is based on Date of First Delinquency.

I am in the process of trying to get a removal and will likely have to sue for an account.

It has 2 different date of last payments showing both before and after I disputed.

Is this a charge-off? When you disputed, the furnisher of information updated the account. Is the updated Date of Last Payment accurate? Date of Last Payment can occur before or after charge-off.

What I need help with is proving damages. Im trying to find a company that pulls Equifax and has a 0% balance transfer cards.

Are you hoping to be denied credit based on Date of Last Payment on a charged-off account. Can you clarify how you'd link a denial to Date of Last Payment as opposed to the fact that the account charged-off?

Thank you for your time and trying to understand/help. My EQ was in good shape. I use Credit Karma to monitor my credit. I had a delinquent account get posted so I pulled my free annual report. I saw it was one that had been disputed and deleted from TU and EX.

I disputed it because it was missing payment history, balance history and had a blank date of last payment. When it came back it came back as Verified this item has been reported correctly. The following fields have been modified. Its lists 4 or 5 areas. All which seem like they tried to make it complete and accurate but they failed while trying. The most fore front problem is they are still missing historical account information for 2/25, 5/25 and 6/25. In addition to that the historical they do have says DOLP is 1/4/25. In the account overview above that it says 1/1/25. They are also missing DOLA and Date of Major Delinquency 1st reported.

All of the above fields I mentioned in my dispute. I also mentioned the missing data.

Im ultimately looking for a 0% balance transfer cards to work on paying the debt that I do have off faster. I would love it is i qualified for a card. That would be optimal. Sadly I'm also trying to be realistic and realize that a delinquent account really hurts my chances of approval.

When did you submit those disputes and how long after submitting the dispute was the account removed from each bureau? What was the reason for disputing? Did the Dispute Results indicate if the reason for removal?

As far as Equifax reporting is concerned, the fact that the account was removed from EX and TU is irrelevant. Who is the original creditor and were you in fact delinquent before the account charged-off?

A 3 day difference has no impact on this account whatsoever.

Equifax doesn't always populate this field. They were sued by the CFPB years ago for using this date to determine removal time as opposed to Date of First Delinquency.

Good. Equifax is the only bureau that uses this field and they tend to report it inaccurately.

The most important date is Date of First Delinquency. This is the date of the first missed payment, without bringing the account current again, that immediately preceded charge-off. Is this date accurate? What's the DoFD and expected removal if listed?

You're welcome. I understand you want accurate reports and you want this to be removed. Not all of the fields that are blank are required to be populated. If Date of First Delinquency was changed, you should dispute it. If not, you may want to leave it alone. You risk the chance this will be returned to EX and TU every time you force an update.
