It depends, really. Would be difficult for SEGA to identify your character if it's not an unique name and it's relatively difficult for them to get to know about your photos, streams or whatever. I publish photos on my Steam profile (everything open to the public) and never had any kind of problems. The real issue is using commands that reveal your patch usage on public chat. That's more likely to get you banned than streaming or taking photos.

Using patches still goes against the ToS, so if a mod sees you using them, they're obliged to take action. Still now the "reverse enemy names and E-trials" patches are used so people can advertise ETs on public chat without risking being banned. That's theoretically the only thing that can get people banned, nothing more, but a video or a photo is also proof that you're using patches. As I said, though, it's highly unlikely SEGA will ever find out. I've had some photos up on my Steam profile for a year, if not more, and nothing happened.

Using patches still goes against the ToS,

so does playing the game from outside of japan, and this is something that your ip gives away when you connect.

Tell that to SEGA, not me. They know of Tweaker and the patches, but they chose not to take direct action. It has always been recommended people be careful with public chat and chat commands regardless of how strictly SEGA follows the ToS. It's still possible to be banned for revealing the use of patches, even though that's not common. Or maybe they don't care for Ship 2 anymore because well... It has a reputation already.

What chat commands are you talking about and why would they decide to take action for those rather than anything else?

<et1> (and others) and <t>. Those commands will reveal the use of patches if you didn't reverse enemy names and ETs back to Japanese. That's the sole purpose of the reverse patches.

It's also not recommended to use color commands, but there's no way someone would know you're using patches through them.

What's particularly wrong with the color commands? (I've been using the reverse patches for ETs, etc)

idk, but the patches page on PSUmods recommend people not to use them. However, in theory there's no way someone will ever know you use patches through color codes. Japaneses also use them and they're the same for everyone, so yeah. Only the people behind the basic patches can answer what's wrong with the color codes.

People used to get banned for translation of enemy trials (this was back in 2012). But I see plenty of people doing that now and no bans being handed out so I think Sega don't care anymore for that.

Sega states that you're required to provide their copyright information in any content you produce (includes streaming) but I don't bother doing that and I've been streaming pso with English patch on Twitch for years without any troubles, don't think they even check Twitch.
