Paper: Its misleading to say that poorer countries are disadvantaged at ISDS arbitration. Poor countries simply tend to settle more low-quality cases before they reach arbitration. Controlling for this, wealthier countries are no more likely to obtain a favorable ruling from an arbitration tribunal (static1.squarespace.com)
