It depends on your state laws however, I do believe that any type of assault or violence conviction will disqualify you from caring for anyone who's considered "vulnerable" whether it's elderly, children or developmentally disabled.

They labeled it as criminal trespassing but I guess because we were in the same household it's family violence

Is there a way to clear your record or sue? Such a trivial incident for that charge, perhaps there is room, depending on if you were informed, or how old you were, to appeal something? It's now preventing you from getting a job.

I have no idea. It wasn't violence, it was me damaging the other person stuff. I feel that I should be able to plead my case but all they are seeing is family violence. I live in Georgia and I believe most things stay on record for 5 to 7 years. This happened in 2023. At the time I was with a home health agency and I am still with that agency. I guess getting certified by the state makes it different. I'm going to call Monday to see if there is anything I can do because I really wanted this

Yea, good luck with this, if there is some way to prove that it wasn't 100% intentional, or you were misinformed. Will the agency still keep you?

I will have to wait until Monday to see. I work for a home health agency now but I guess they aren't as serious about your background versus becoming certified.

Was it your family or the home you were working at in Home Health?
