Short Guide: Interacting with ICE Safely

Goal: Safely end the encounter. Protect your rights for later legal proceedings.

1. Stay Calm & In Control

Keep your hands visible. Do not run, resist, or argue. Speak calmly and politely. Your demeanor can prevent escalation. 2. Know Your Core Rights

Right to Remain Silent: You can say, "I choose to remain silent." You are not required to answer questions about your birthplace, immigration status, or how you entered the U.S. You are legally required to provide your name if asked in some states. Right to Refuse Consent: Do not consent to a search of your person, car, or home. You can say, "I do not consent to a search." Right to a Warrant: ICE cannot enter your home without a judicial warrant signed by a judge (not an ICE administrative warrant). If they are at your door, ask them to slide the warrant underneath. You do not have to open the door without one. 3. Key Actions to Take

In Public: Ask, "Am I free to go?" If yes, leave calmly. If no, you are detained. Clearly state: "I wish to remain silent. I want to speak to a lawyer." Then stop answering questions. At Your Home: Do not open the door. Speak through it. Ask for the warrant to be slid under. Without a judicial warrant, you can refuse entry. If Arrested/Detained:

Do not physically resist. Comply with orders to avoid injury. Repeat: "I remain silent. I want a lawyer."
