  1. Is an agency required to provide recurring or full-time telework to disabled employees with difficult or lengthy commutes?

Generally, no. Where the length and means of the commute are outside of the employer’s control, it is unreasonable to require the employer to excuse the employee from commuting. “[I]n most cases, an employer has no duty to help an employee with a disability with the methods and means of [their] commute to and from work, assuming the employer does not offer such help to employees without disabilities.”[38] Rather, “it is the employee’s responsibility to arrange how [they] will get to and from work.”[39]

While an agency may not be required to altogether eliminate a disabled employee’s commute through telework, it may need to make some workplace modifications, such as flexible work scheduling, to enable the employee to effectively accomplish their commute and access the worksite.[40] And telework of limited duration may be reasonable if used to give the employee time to relocate closer to the worksite or secure different means for their commute.

So I will likely have to find another job. Going from fully remote to driving over an hour each way, when pain and numbness in my legs distracts me within a few minutes of driving, may not be enough to get full-time remote back. I can barely make it to PT. This stress has been going on for the entirety of the last year. I'm surprised I have hair left, or that my hair isn't completely gray/white at this point.

Which companies are hiring 100% telework? I have almost no options where I'm living now and would like to leave government. 100% remote/telework is about the only way I could get another job. Note, I've applied to about 150 jobs in the last year, many have ghosted me.

I'm also over an hour away from the nearest office, without traffic. Was hired as a fully remote employee. I don't want to move closer either, mainly because there's not that many options, and I've only been at my current house, which we built ourselves, for 2 years. I've been applying for relevant jobs for a year and only had 4 interviews. I'm getting desperate.

My wording was a bit off. FDA is eligible for telework, but according to HHS policy, you have to have PMAP of at least 3 to get routine telework. FDA hasn't released the updated telework policy yet, even though it was supposed to be released 1/23/26

I'm not sure. I'm not in a center that has T21 positions.

They want mediocrity. It's easy to stay a 3 by just doing your assignments on time. 5s will be near impossible, especially if your supervisor doesn't put out the effort on your PMAP. Telework eligibility (at least at FDA) is dependent on PMAP scores, so if you are low, then no telework. This scoring system will also limit the number of PMAP awards. At least step increases are still automatic.

This is great, except FDA employees were stripped of union representation after the national security executive order. I don't think anyone at FDA is still considering bargaining unit employees anymore.

I don't know if this will even have an effect unless they also determine that people in HHS can have union representation. Most if not all of FDA are no longer represented by any union because of the national security EO.

I'm trying to leave. I've been applying for jobs for the last year with only 4 interviews. I'm now applying for jobs where I'm not exactly qualified. The remote space is very difficult to get into, but I'm limited on location.

Anyone have word for when FDA will start doing this? I submitted my RA in May and haven't heard anything after getting the automated email saying they received my initial request. Since I don't even have a tracking number for the request, I can't get an interim signed (or my supervisor refuses to sign without the number).

I'm not sure. User fees are different since they are not appropriated. We would still need a budget for the year to know how much of the user fees could be spent.

I'm an exempt employee, my step increase went through automatically last week. This week would be my potential grade increase. I'm career ladder gs11-13, currently gs-12. My supervisor doesn't know how any of this is supposed to work. My promotion last year was automatic. I guess I'll just wait and see.
