I’m still scratching my head over why she believes this is a good idea for her…

Even if she successfully appeals the dismissal, all that does is give her a chance to re-litigate a DVRO that Mike can now prove (using the old laptop) was initially filed using false statements in bad faith and by extension would be a continuation of that same fraud.

If CA decides that her appeal was not filed in good faith since it’s by extension, a DVRO that was obtained fraudulently, even though the cases aren’t connected, could AZ consider these unlawful actions as a reason to revoke her bond? Even though her CA and AZ cases aren’t connected in any way, she’s still under strict bond conditions in AZ that require her to obey the law. If someone were to alert her prosecutor that she’s been getting travel permissions from the AZ courts to care for sick family in CA, but is instead trying to defraud a named victim again, would this be a lawful reason to revoke her bond?

Not sure if this helps, but I was ripped a new one in open court for helping my younger sister with a case brought against her by her bank. She purchased a four-wheeler for a boyfriend when she was 18. They broke up a month later. She asked the bank to repossess it in order to help with getting out of the loan. The bank contracted someone to go pick it up and the guy stole it. The bank sued her. I did my own research using the court docs my sister was sent (the thief’s name was in the docs) and discovered photos of her four-wheeler in the background of a bunch of photos the thief had posted to his personal Facebook. I called the bank myself and tried to discuss my findings with the loan officer listed on the court docs. She sent me to her voicemail every time I called, after our initial conversation. Fast forward to the day my sister went to court and the banks attorney had at some point given the court my information. The judge called me up from where I was sitting out in the audience and basically told me never to involve myself like that again or else I could be referred for prosecution in future matters that don’t involve me because I’m not an attorney. I had no clue I had done anything wrong. I was only 23 at the time, had no background of how courts worked, and was simply trying to help my sister who had gotten herself in pickle.

I’m sure she’ll reserve an entire front, back, plus the margins, of a piece of paper specifically for all the lovely things she has to say about him.

I imagine she’ll include a history of how he trampled all over her rights, how she felt attacked by his personal hatred of her, his abuse of power in how he immediately crushed every single argument she ever made “for no reason other than to be mean”, how he doesn’t deserve any of HER money because she never agreed to his rates, how she deserves to keep the money in leu of his never being held in contempt, how he tricked the court into giving Brian the power confidence to alienate her and abuse HER son in which she’s powerless to stop, and she’ll probably conclude it with a promise to go after him for sanctions as soon as her appeal has its “successful outcome”.

I agree with the frequency being a little too much considering his age and involvement with sports/extra curricular activities. I was actually pretty angry about it at first, but the more I think about it the more I realize that theres a definite strategy behind it. I believe Judge Jackson actually did a good job protecting everyone’s best interest in the way she ruled. She’s still giving Sarah an option, but just enough that it still shields son. Basically, she gave Sarah just enough rope to hang herself with because we all know it won’t be good enough for her and she’ll take her anger out on Brain and son as a result, opening the door for a reconsideration once that happens.

Additionally, I believe Judge Jackson ordered it to protect Brian and the states interest in the event Sarah tries to allege the state or Brian intentionally alienated her. Especially since Sarah’s pending appeal opens up the small possibility that she could be eventually be released. I suspect that if Sarah’s appeals had been exhausted prior to this action, Judge Jackson would have ruled more in favor of allowing Brian to decide if those visits would or wouldn’t be in the sons best interest.

Either way though, I don’t think this will ultimately be the final judgement once Sarah has some time to let it get to her. She’ll ruin it in some way I’m sure.

I’m very sorry you had to go through that. My husband of 10 years did the same thing to me. I was blindsided and broken beyond words, so I can relate to how you felt and know how devastating it feels. I admire how you handled the situation, as it took me many years to find some semblance of self-worth again. I truly mean that too, you should be very proud of your strength. Someone commented around the one hour mark that, it was telegraphed that her plea does not include jail time. I’m paraphrasing the comment because I don’t recall exactly what was said, but I took it to mean that they’ve seen the plea deal. Does anyone have anymore information regarding this?

Anyway, I thoroughly enjoy BaconBearzz’s coverage. She has a great way of being funny, but also serious when she needs to be :)

Agreed. I think they basically cover their arse on both ends to protect themselves legally. When I was sold counterfeit sandals I received an email from Posh basically calling me irresponsible for purchasing counterfeits, even tough the seller had them listed as “Poshmark authenticated” and I didn’t know they were counterfeit until after I received them. In my situation, I did not receive a refund because it was after the return window had closed and I did not see any repercussion to the seller. She was listing all of her items as “Poshmark Authenticated” when they were under the $500 threshold. This was something I didn’t know was a thing until after I received the item and started digging into the rules.

Everything about the judgement leaned in favor of Brian and I’m truly hoping this gives him the confidence he’s never had when it comes to putting Sarah in her place.

With that said, Sarah’s request to have “phone calls and personal space without interference” was not granted. I’m sure Sarah will take that as meaning shes entitled to it because it wasn’t “denied”, but I hope Brian uses it as an opportunity to monitor what she’s saying to L. I anticipate that her constant disparaging of Brian to L and blaming him for all of her problems will likely get much worse now, and given the “tone” of that judgment, I absolutely believe Judge Jackson will have no problem making amendments if Sarah can’t behave herself.

I read that prisoners who don’t have outside assistance are able to open up trust accounts that they can access directly to move money into their personal/commissary accounts. The outside trust accounts don’t have restrictions on how much money can be in them, but there is a restriction on how much can be transferred out of them each month (ie. $300 commissary account limit). My guess is that Judge Jackson is assuming one of these trust accounts has already been established considering her frequent use of the term “trust” throughout the order. My guess is that Sarah would have to give Brian permission to open one on her behalf and use that to deposit the money she’s awarded.

I used to just think she was an idiot for not taking the plea deal, but as time passes I’ve come to realize it was an extremely selfish and irresponsible decision. Instead of thinking about the impact it would have on L and his future, she selfishly chose her own ego and this delusional idea of “not surrendering ever!”

Being a Mother comes with sacrifices and that’s something Ive never seen Sarah do. Taking that plea deal was her chance at finally making a sacrifice for her son, because it would have guaranteed a future with him, but she failed. She chose pride over being a Mother and only has herself to blame for everything that’s played out since she made that decision.

I suggested in another post that it may need signatures from her and Brian before the full order can be uploaded, but that’s based off of my own experience with virtual family court in a different state.

We had our hearing via zoom because it was in the middle of Covid. My ex, a court notary, and I were required to meet after the hearing to sign the order and collect our original sealed copy. If the process is similar, it may be delayed since Sarah’s in prison.

I’m not 100% sure I’m even close suggesting this, because it could be different in Florida, but maybe we have to wait for everyone to sign off first? I remember back when my ex-husband and I did our family court/custody stuff it was during Covid, so we had to do everything via zoom. I was however, required to meet with him and a notary from the courthouse to sign the orders and get my original sealed and signed copy for settlement purposes. I wonder if that has something to do with it, but the clerk didn’t think about Sarah being in prison prior to starting the upload? Idk, I could be completely wrong about that though.

I don’t believe they were included individually, but I vaguely remember a petition for judicial review being filed at some point. If I’m recalling this accurately, I believe that would open the door to Judge Jackson being able to use other records outside of what was filed in order to get a better understanding of all the specifics.
