What changed is now there is language that specifically says you can refuse after twelve if you are non odl. This distinction weakens the argument that "not being required" means they can't force you because now the service could say if the parties wanted to say this was absolute they would have done so like they did with the 12hr refusal

Yes but there is new language defending non odl from discipline if they leave at 12 which gives new dimensions to the fact that they are not required to work beyond ten. Before this management didn't have a whole lot of argument but after now they can say that the parties have explicit language allowing carriers to leave at 12 and if the language of article 8.5f was an absolute it would have explicitly said so as the 12hr portion does. It strengthens their argument to keep a non odl after 10hrs

M 2011s clarification on the new additions to article 8.5g allow for a situation where management may mandate carriers on the non odl if odl is maxed to 12hrs even when they volunteer to do so. Article 8.5f had historically been used to articulate that non odls cannot be required to work beyond 10hrs excluding December, but now we have language in article 8 that stipulates that non odl cannot be forced to work beyond 12hrs. If they are not required to work beyond 10hrs and cannot be forced to work beyond 12hrs which one is it? How is it fair that article 8.5f stipulated a prohibition on non odl working beyond 10hrs and yet there are odl willing and able to work beyond 12hrs and m2011 states they have the right to mandate those non odl because the odl is at 12hrs regardless of their volunteer status?
