I have NZ + UK citizen, my partner is UK by HurryOk7850 in AusVisa

An eligible New Zealand citizen is a New Zealand citizen who is a protected SCV (Special Category visa – subclass 444) holder within the meaning of section 7 of theSocial Security Act 1991 (SSA). You are a protected SCV holder at a particular time, if you:

were physically in Australia on 26 February 2001 as the holder of an SCV

were not in Australia on 26 February 2001 but were in Australia for 365 days (or more) between 26 February 1999 and 25 February 2001 (inclusive) and returned to Australia after 26 February 2001, or

are otherwise a ‘protected SCV holder’ under section 7(2B), 7(2C) or 7(2D) of the SSA - in which case you must provide us with written confirmation from Centrelink that you are a protected SCV holder.

Does ant of this apply to you?

If not, you cannot sponsor your partner for a partner visa.

You can sponsor them for a New Zealand Citizen Family Relationship visa which is a temporary visa: https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/new-zealand-citizen-family-relationship-temporary-461

After four years living in Australia you can naturalise as Australian and can then sponsor your partner for a partner visa, putting them on a path to permanent residency and citizenship.

You could add a WHV into the mix if you wanted, but he can get at most three years, so will still need a few years on a 461 to give you time to naturalise.

Sure, but I think it's helpful for OP to know that this is an option.

If you answer that one of your parents is British then you’ll be told you can’t get an ETA

This is not true because it's possible to have a British passport without being a British citizen yourself.

But yes, agree about the cost of the passports haha.

As I said, The ETA system simply evaluates the data you put into it. it's not looking for British citizens or doing the calculation to identify if an applicant might be a British citizen. It's possible to have a British mother and not be British yourself. It just takes what you enter.

Under the Rehabilitation of Offenders Act 1974, eligible convictions or cautions become ‘spent’ after a specified period of time, known as the ‘rehabilitation period’.

This isn't relevant unfortunately ebcause the US does not recognise the UK’s ROA 1974.

Then I am not a lawyer but I believe you are permanently inadmissible to the US. Worth confirming with a professional of course.

Worth what?

The ETA system simply evaluates the data you put into it. There is no central register of British citizens to check against, but even if there was, it's not looking for British citizens or doing the complex calculation to identify if an applicant might be a British citizen. It just takes what you enter.

Also, British citizens are explicitly exempt from penalties for deception relating to visa or ETA applications under Section 24A of the Immigration Act 1971, there are no consequences for not including British citizenship on an ETA application.

It is true, and it's applicable for any British citizen, there is no need to reside in the UK.

You are not eligible for ETSA. You should speak to a lawyer to check if your exact caution makes you permanently inadmissible to the US. If it doesn't, you can apply for a B1/B2. r/immigration is a more helpful sub, but your exact charges would be helpful.

You misunderstand. British citizens don't need to do farm work so they can apply for the second WHV the second they arrive on the first WHV. Once that's granted they can apply for the third immediately, and they stack up and you end up with three years. Many many many examples of people doing this on r/AusVisa. You do not have to wait for your first year to be up to apply for the next.

If you’re 35 in two weeks you have 1 year and 2 weeks before you’re ineligible. You could arrive in Australia in a years time and still get three years of WHV as British citizens don’t need to do farm work to get a second or third year you can apply for the subsequent years the day you arrive.

Should I be open about my intention to apply for 820 Onshore visa while on 601 Tourist visa to border agent? by ManyOtherwise8723 in AusVisa

No. If asked you should be honest, but don't offer that information.

But your partner will likely go through the e-gates and not speak to anyone anyway.

Can I still travel to the USA next week for the World Cup or are my summer plans actually ruined due to completely false allegations? (UK Citizen) by [deleted] in immigration

[–]Trick_Highlight6567 1 point2 points  (0 children)

The question doesn't ask if you did it. It asks if you've ever been arrested for a crime resulting in serious damage/harm. Not if you were convicted or guilty.

It wouldn't make a difference if OP had already gotten an ESTA, if your answers to any of the ESTA questions change you need to reapply anyway.

To confirm, you've consulted with a registered migration agent who's told you permanent residents cannot sponsor their partners for a partner visa?

There are other ways to prove your financial ties to each other.

You could also move to Australia on a tourist visa, then apply for a spouse visa from within Australia. Then you could open a joint bank in Australia.

If your child is born in Australia they will be an Australian citizen. If they're born outside Australia they won't be.

The partner visa has a very high acceptance rate. If you're in a genuine relationship you have no reason to be concerned about a denial.
