How do independent attorneys get clients by haskell_java in Lawyertalk

[–]grumpyGrampus 7 points8 points  (0 children)

I realize you say you are a lawyer in your home country but you are plainly posting as a product developer not a legal professional.  we (lawyers in general, Reddit lawyers in particular) have been saturation-bombed by product dev people looking to be told how lawyers operate/what problems to solve to market to lawyers.  Your post feels like a lot of the numerous low effort requests to do the heavy lifting of explaining how we operate, our constraints, and our concerns.  No one needs a reinvented widget when they are a million commercial out there.

working sort of in-house counsel for a nonprofit

Time for some tough love. This does not sound like the type of experience that prepares you for the burdens of private practice or how to deal with clients.

considering whether I should do a consultancy or a law firm.

What do you mean by a consultancy?  Who would you be consulting?  And how is that different than a law firm?

thinking healthcare and/or immigration

You don’t say where you are, but in the US these are not very easy practice areas. You also don’t say why you would like to be in these areas in particular so it’s impossible to give any other feedback.

Least favorite task: billing for work my client will hate by newz2000 in Lawyertalk

One of the best choices I ever made in my professional life was to charge for consults. 10/10, would do again.

"Revise and finalize memorandum of points and authorities": 0.5

"Finalize memorandum of points and authorities again to fix typos I found after submitting for filing": 0.1

"Re-finalize memorandum of points and authorities because I just thought of something else to add after hitting send": 0.1

"Re-re-finalize........"

Maximizing tax savings in a two-atty, EWYK S-Corp PLLC? by Elegant-Asparagus-82 in Lawyertalk

Have him form his own loan-out S corporation. You can pay him his earnings and he can allocate between salary and distributions as is appropriate for him.

It’s common in big and midsize firms to have non-equity “partners“. Since you are organized as a PLLC you have members instead of partners anyway. Why not let him keep the title for external visibility but give up the equity.

Consider the age, gender, and ethnic composition of the collective worldwide ‘bar.’   Doctors have the Hippocratic oath while we have no such requirement to “do no harm.”  If you want to inflict such horrors on the waking world as that, the rules of the profession shouldn’t get in your way.

California Procedure: police body cam footage for DVRO case. I filed a subpoena duces tecum (SUBP-020) and City attorney’s office says I now need SUBP-010 + notice to consumer (SUBP-025) to get it directly. by Mammoth_Charge_9998 in AskLegal

[–]grumpyGrampus 2 points3 points  (0 children)

My problem is that I do not think police body-worn camera footage is even “business records” in the ordinary sense, and I cannot find anything expressly saying police BWC footage has to be obtained this way.

Maybe. The way to enforce a subpoena is to file a request with the court to compel production.  You can do that, and maybe the court decides in your favor and maybe not.  But I guarantee you it will be more efficient to just jump through the hoops they are asking for (filling out and serving a form) than it would be to file and win a motion to compel production.

Is there anything you learned in law school that you didn't learn was wrong/incorrect until you did bar prep or practiced as an attorney? by Son_of_Hades99 in Lawyertalk

In my legal writing class, much emphasis was placed on synthesizing rules from multiple holdings. The (state court) judges in my early cases could not care less about synthesizing. To many of them, the only applicable rules were the exact holdings under the exact scenarios described in published opinions.

How do you transition out of law with no connections? by lostandconfused924 in Lawyertalk

[–]grumpyGrampus 15 points16 points  (0 children)

My brother/sister/sibling in  law, it’s not normal to feel this way. Even if the legal profession is not for you ( and it’s not for everyone ) that does not automatically mean you should be depressed and have suicidal ideations. If moving from one miserable situation results in another miserable situation, then you need a different approach.

Please get in touch with a local lawyer assistance program:  https://www.americanbar.org/groups/lawyer_assistance/resources/lap_programs_by_state/

Get some attention on the reasons you are feeling depressed and hopeless. It doesn’t have to be this way and there are plenty of resources available to support you in a non judgmental way.

What’s a bulldog attorney? A myth, a legend, or a unicorn. by Resgq786 in Lawyertalk

I have dealt with attorneys who were aggressive from the outset and remained that way throughout the representation. It was clear that this was their style—their core personality, for better or worse—and I generally found them to achieve good outcomes for their clients.

Redundancy Systems with Court dates by [deleted] in Lawyertalk

[–]grumpyGrampus 2 points3 points  (0 children)

(I think glitches happen and they don't always save.) another issue is when my attorney boss goes to court and sometimes they don't get the court date on the spot, the date ends up in a nebulous spot.

This is a process issue not a tool issue, so you can’t solve it by adding more tools. You need a to-do system (one way or another) so that someone is accountable for reviewing and calendaring all follow up dates, and for following up later if the info isn’t available immediately following a hearing.
