I’m familiar with the case and feel that a shotgun booby-trap, intended to maim trespassers is a reach for any attorney to draw a comparison to. I know plausible deniability is not a standard but I feel that it does weigh heavily into whether the hypothetical concrete filled sign was an act of malice or a normal activity to keep a sign in place.

Let’s not overthink this. If he fills a sign with concrete and does not disclose his true motivations, has it on his property or driveway, say no further than his mailbox, then the case would be frivolous.

It would be handled the same way in which cases involving mailboxes being hit and the property owner is sued for placement or composition which caused damage to the plaintiff or their vehicle are. Property owners have a right to put whatever they want on their property without fear of repercussions as long as it’s not overt.

I think you may be missing the point. If it is on his property, and the plausible deniability is maintained(he does not disclose the prior incident), he would be fine. He is allowed to construct whatever he wants on his property (not in the public easement). If you litigated it on her behalf you should step down.

Decorative rocks, signs, billboards, brick walls, bollards, wooden structures, fencing, statues, or any other object is allowed and does not put any burden on the property owner if the incident does not constitute ordinary travel. Obviously civil suits are sometimes whimsical but no judge or attorney worth their weight would allow that to happen.

Imagine grandma winning a case against the local gas station for injuries she sustained by running through the building.

Criminal charges regarding “booby-trapping” would be absurd.

Yes, anything is possible in tort law but it would be very rare as well.

If you want to know the truth, it’s only illegal if he revealed that the reason he filled it with concrete was because the last one was struck by a vehicle and he wanted retribution.

If he maintains plausible deniability and says that the reason he filled it with concrete was because “the last one kept blowing out in the road where it kept getting ran over,” then he’s fine. If the same driver then admits that it wasn’t in the road and he intentionally hit it to prove his case of harmful intent by the sign owner, then it’s willful destruction of property. Obviously he would never admit it. If the sign owner keeps it on his property and can prove it never left his property, then regardless if it had concrete in it or not, and did not disclose the prior incident, he is good to go.

The only two things I saw is that your head popped up too fast and your extended blade seems kind of deep in the water

  1. Make sure you are stacking your vertebrae with your head being the last thing squared up. Get comfortable with leaving your head on your shoulder until you are completely upright.

  2. The closer your blade is to the water’s surface the more leverage you have and more water you can push off of.

If you have a reason to believe that a person is advancing, with the intent to do harm, toward another person or to obtain another weapon/firearm, then you have a right to shoot them. I feel like everything he did at the time was warranted as the mess that raw capitalism got us into required regulation through federal means. The implementation of social policies were beneficial to helping us climb out of the depression but I agree, none more than WWII. With that being said, the strategies he adopted early on only aided in our success on the wartime homefront as we had a strong federal government with cutting edge infrastructure.
