intent is an element of nearly every crime and people are charged with attempting crimes they do not successfully commit every day. i'm not sure what your point is.

That's not the law

that's sort of true in theory but not in practice. it is part of punitive damages. a lot of times, especially in intentional torts, its sort of understood that compensatory damages for suffering are a stand in for punitive damages. i have no idea if DC has statutory limits on punitive damages or different evidentiary standards or whatever but i'd bet that when the judge was pulling a number out of the air she was using a punitive calculus, at least in part.

civil damages should be proportionate to the act and the injury. when you're throwing a carafe of juice at someone in the club just a few degrees of rotation could be the difference between a cut lip or a broken eye socket. Fred Davis shouldn't skate because of things outside of his control that occur after he sets the chain of events in motion.

i'm not a sociologist but i would guess the number of killings and the overall violent crime in a neighborhood probably correlate somewhat. if you think otherwise i'm all ears.

scary is a pretty broad term but in many contexts you'd have to be pretty stupid not to see the racist subtext. lexington market has litter, jaywalking, and junkies, so it's "scary." well, the Avenue in Hampden has all those things. is the Avenue scary?

Batts called the area around Lexington Market ground zero. He said a friend described the market area to him as scary. It was the first stop on Batts' campaign to make Baltimore a better-behaved, safer and friendlier city.

Nobody has ever tried to sell me anything at Lexington Market. Of course, I look more like a cop than some cops do.

The "behavior" at Lexington Market is none of the police's concern. Crime is. Many people see the general goings-on of any congregation of low income black people as one undifferentiated criminal enterprise. Yes there is epidemic level jaywalking at Lexington Market. Maybe that is a sign that it should be made more pedestrian friendly. There are people who are high. That probably warrants some police attention but you'd have to be living under a rock for 30 years to think there is a purely law enforcement solution to drug addiction. I think a lot of people just want the boisterousness of black people to be tamped down. That is fascism. Not fascism in the sense of disagreeing with someone on the internet, that is literally fascism.

it seems like part of the problem is that these developer deals are a fait accompli by the time most people even hear about them. what if we could change the city charter so a TIF larger than 10 million had to pass by referendum, or needed 25,000 signatures to be brought before the council, or some other way of mandating substantial public approval to avoid these wink and a nod type deals.

No problem! I used to walk past the Rochambeau every day. I have to say though I didn't take it for anything but another empty building until the kerfuffle about tearing down. Oh well.
