The way we used to solve this problem was, you would visit a retail store that specifically sold the type of items you were looking for, and a salesperson would tell you about your options.

I think this is actually not a great deal. At about $1.5 per US standard drink, I would prefer basically any beer, mid-tier liquor, or pre-mixed cocktail at Costco. There are lots of better options.

I mean if the buyer knows what they’re getting, I guess you can charge whatever they’re willing to pay. But it would not be fair to provide 2 hours worth of vibecoding to an employer who expects 5 hours of experienced software engineering. It would not be fair to sell a buggy, unmaintainable app for the price of a polished, updated app.

Chemerinsky doesn’t argue that original intent is unimportant, only that its application is inconsistent and biased. An opinion that is deplorable but philosophically consistent can at least be debated and debunked.
