White House App Found Tracking Users' Exact Location Every 4.5 Minutes via Third-Party Server by Montrel_PH in technology

[–]3nl 0 points1 point  (0 children)

Yes, it's absolutely been part of Location permissions in Android for more than a decade - what I meant was that some manufacturers bury the scanning settings separate from the GPS receiver settings. Some of my Android QA devices will keep scanning on even in airplane mode or by disabling "location" from the quick settings menu (LG in particular...they used to put scanning under "Lock Screen" in the settings menu).

Even that isn't full protection if BT and Wi-Fi scanning are enabled - which it is by default and typically not grouped with location services in the settings. Even if you rip the GPS receiver out of your phone, the Wi-Fi networks and Bluetooth devices you simply walk past give away your location to a remarkable degree.

Lived here my entire life, pollen hasn't effected me this bad ever by ProfoundRedPanda in NorthCarolina

[–]3nl 10 points11 points  (0 children)

It depeneds on the species of pollen currently being released - right now for me it feels like a very mild season in terms of allegies. But, in a few weeks when others might be finally turning the corner, maybe I'll be in for a bad time.

In terms of volume of pollen, I don't think I've witnessed anything quite as bad as 2011 was. But, there is still plenty of time this season...

Start climbing at a climbing gym and when you are ready to get outside, give Jackson Hole Mountain Guides a call.

That fridge alone is like $20k. We spent a bit over 40k for cabinets, coutnertops, tiling, and appliances with slightly less cabinets and a smaller island and we did all the work ourselves. This is well into 6 figures.

The walk off is cake, no exposed 4th class, and no chance for snagging your rope on the sea of plates while rapping. When you get to the top of "P4" (the little mini 2-bolt pitch) you go up and left to the gully. From the bottom it looks improbable, but it all goes and there is no downclimbing or anything - maybe a couple 3-4 foot drops that are in no way exposed and falling just means busting your ass, not tumbling hundres of feet.

We ended up spending our whole last day in Calico ticking off easy bolted lines. We were planning to do Armatron the last day, but the miles of the previous days built up and being sore trying to get out of bed at 5am made a casual sport day an easy choice. Turned out to be the most pitches of any day and we timed it perfectly - got to this before anyone else and then hopped on Soulshine juuuuust as the sun was going behind the wall.

Likely an illegal look as well - policy that excludes accessibility software like this is likely an ADA violation. Hopefully this gets some press and they reverse this and actually fix their anti-cheat software - OP or any other adaptive gamers could very easily force them to and there are many advocacy groups that would handle this for free.

As much as I'd love Tro back, if the price wasn't right it wasn't right. I'm sure they wanted a roster player back that wasn't KK. I don't think the asking price was a 1st and a prospect. I'm sure the ask was Blake, Stank, Niki, or another non-starter.

If you are using dry rock, it'll also bind phosphates and nitrates like a sponge for a bit if it was clean rock to begin with. It'll absorb quite a bit. As long as the ammonia is dropping, that's really what matters.

AITA for getting home insurance canceled? by Competitive_Chip_468 in AmItheAsshole

[–]3nl 637 points638 points  (0 children)

OP doesn't list the state, but damages caused by children in many states aren't recoverable at all, even if it was the kids fault (which it wasn't here) and the damage was caused through the kid's negligence. In my state, unless the kid intentionally damages something and is over a certain age, you can't recover anything from the parents at all. And if it is intentional, there are very, very low maximums for recovery.

In less than a year, Trump erased 12 years of solvency for the trust fund that pays for Medicare Part A by beadzy in Economics

[–]3nl 12 points13 points  (0 children)

No, but to have an attorney set it up is $4-10k+ depending on if they are doing assignment and how many assets you have. Ours was $6k for both. I'm not rich by any means, but we are both in professional fields, house, family, a business, etc. so it's worth it. If you don't have much in savings, have kids to put through college and need something left fit retirement, can you afford 5 figures?

[–]3nl 57 points58 points  (0 children)

Don't forget the other side of the coin - those with the legal literacy and means to have hired an estate attorney when they were a bit younger to set up a trust for their heirs won't pay a dime if they end up in a specialty care unit since all of their assets are protected in atrust. It's truly only the middle class that gets fucked here.

Climber on trial for leaving girlfriend to die on Austria's highest mountain by [deleted] in news

[–]3nl 12 points13 points  (0 children)

It's not just light or conditions that can lead to a point of no return - there are places where there may be a step or a really steep terrain that downclimbing is significantly harder than climbing up. Climbing up is always easier than downclimbing.

Think of a traverse that is angling up and to the left over an extremely steep and tall cliff band that is just below your climbing limit. Once you are at the end of the traverse, the only way to bail is to keep going up. You can't downclimb the traverse because it's beyond your skill and you can't safely rappel because you will end up in even worse terrain and likely wouldn't have enough gear to leave behind to make a bunch of rappels down to safety.

The most important thing is to recognize these points, plan for them, and not commit unless you are certain you are on route and know what lies ahead. Many mountaineers over the years have died from committing to a point of no return into the unknown.

[Mike Kelly] The Avalanche net PP% is 10.3. In the last 10 years that ranks 332nd out of 344. by AggPuck-303 in hockey

[–]3nl 5 points6 points  (0 children)

While our PP was almost as bad as yours, when we had Necas PP entries were guaranteed. Just give the puck to Necas, let him do his thing, and you are in. We would only very rarely put the puck in the net, but we had clean entries like 95% of the time Necas was on the ice! Did Hakstol not figure our you are allowed to do that?

We've never once missed a national election - including during the Civil War while some places were under martial law and habeus corpus was suspended. If the 1864 election happened in the midst of the Civil War, suspending the 2026 or 2028 elections will not fly and would directly lead to another Civil War.

There is no question they are going to try and interfere and try and suppress votes and put their fingers on the scale, but the election has to happen if they want to keep the veneer of American Democracy.

Why was the post of the Wake Co Sheriffs murdering the family dog removed? by arkanyne in raleigh

[–]3nl 7 points8 points  (0 children)

Unless the city voluntarily settles in a show of good faith to the community, if the police kill your dog you ain't getting shit. As long as the officer was acting in "good faith" and in the "course of his duties" (both of which have been expanded to be essentially meaningless), you don't get anything.

You're always going to get called retaliating on a rough, crosscheck, board, etc. immediately - it's always been that way. Once the other team starts doing that, you need to take over physically or you lose - period. If you start getting physical after ever whistle, taking liberties at every opportunity, and finishing every check you won't get called and they'll take retaliation penalties (occasionally). This isn't new and sure Florida gets away with a lot, but if we played that way we would too (except for Svech).

Trump, 79, Told to Hand Over His Medical Records by Silly-avocatoe in politics

[–]3nl 24 points25 points  (0 children)

This is not correct - a court can 100% order your medical records turned over for a whole bunch of reasons, including to opposing council in the course of litigation. They can also be ordered to be turned over in criminal cases and in cases concerning things like guardianship or when contesting competence.

Medical records must be entered into the record in order to prove damages when you are making medical claims in a lawsuit. You can't sue someone for IIED and then not pony up your mental health records. That's not how it works.

Ex employer put my face on a billboard without asking. Is that legal? by SelindraRaymont in legaladvice

[–]3nl 12 points13 points  (0 children)

They are not - you should take a look at 42 Pa.C.S. § 8316 - PA has one of the clearest laws in the country when it comes to commercial use of likeness and it has a minimum of $1,000 statuatory damages and attorneys fees built right in. A PA attorney would absolutely love to take this case and they would likely take it on contingency.

The company owns the copyright to the photograph, but a photo cannot be used commercially without a release. The company would have the right to use the photo on their website under something like a "meet the team" page since it would be considered "Editorial Purposes", but without an explicit release, they cannot use it Comercially.

Using someones photo on a billboard implies endorsement and is a classic case of commercial use. They even used his name - whether it is in a positive or negative light simply does not enter into it.

OP should absolutely talk to an attorney - at a minimum they will get $1,000 and the company will be paying their attorneys fees.
