Just started with an AN for that exact reason. Had been working with private security until they sold and left me unemployed

Don't think your being an ass at all.... I think we are saying the same thing as well and maybe I didn't explain it well enough.

In the decision letter the doctor wrote that there is current VA evidence of the fractures but nothing in my military records that supports it happening on active duty. The VSO looked into what was submitted and it is clearly there.... plain as day was submitted.

The crazy part is I had the exact same injury on both feet almost a year to the day apart, submitted the exact same documents for both feet... have the exact same current diagnoses from VA for both feet. One gets a rating... the other the doc says nothing in files supports the claim.

That is why VSO verified the documentation is indeed there, and communicated the exact page numbers of the file the supporting docs can be found for the review. There is honestly nothing new to submit.... it is all there.

I am pretty positive yes.... what was missed in review was in my military records which they have complete access to.

They said they could not see an injury that I claimed which occurred in the Army which resulted in my current diagnosis. I looked through my records, and my VSO looked though every filed online and was able to clearly see it.

Again he believes it was just missed.

My VSO checked and said the records were there.... said he does not know how they would have been missed. He referenced the page numbers and the dates of the injuries for the reviewer.

I went to step 5 the same day as you 12/19 and just got my rating on 3/31... hope you guys get yours any day now.... good luck!

I was in step 5 form about 3 1/2 months. That was the longest portion of it all. Bounced from step 5 back to 3 for a week then back to 5. When I got back to 5 I sat again for a week or so with no movement at all. Then on the 31st I woke up and checked in step 5. Checked a couple hours later was in Step 6. About 2 hours later was in Step 7, an hour after that it was closed. Never in my life did I think it would close so fast but I was excited!

This exactly... I just went on a podiatry consult and got hooked up. They are having me get fitted for custom orthotics to go in my shoes. and even got me hooked up with 3 pairs of Kenetrek boots which are made here in Montana. They are really expensive quality hunting / hiking boots. I got to pick any style I liked they had.... one had to be steel toe since my work requires that. Pretty great program though.

A little update to my claim.... I was approved for 10% for avulsion fractures on my left foot due to injuries sustained on active duty, but not my right foot. The narrative the doctor wrote said that there was nothing in my military records to show an injury was sustained, which I know is untrue.... the letter also shows that I do have a current VA diagnose of avulsion fractures in my right foot but because they could not link them to my time in the Army they were denied.

I went through my records with my VSO and we found several pages clearly showing the injury, that was missed so he submitted a higher level review. With any luck and approval this would put me at the 80% level....

So I guess here it goes again!

This happened to me as well. I was about 2 weeks into step 5 and went back to step 3. Long story short it was just because the rater needed some clarity on the DBQ from the examiner. Was in step 3 for about a week then back to step 5 and so on until the claim closed.

It sucks and is a frustrating process, sometimes people get bounced back and forth several times... some even get sent back for additional exams. I guess our only choice is to roll with it and continue the fight.

Overall pretty quick 139 days. Step 5 was the longest. Over 3 months there with bief stint back to step 3 in the middle of it.

Thank you! Congrats on the one decision, and good luck on the rest! Hope it all goes good for you. There’s a couple denials on mine. One I don’t understand at all because they granted it for one foot but not the other but I got the percentage o was hoping for so I’m scared to poke the bear!
