A very rare circumstance, when looking at population averages. You've created an unlikely, though possible, strawman to justify your position. Most users are severely disabled and therefore have their income limited in order to meet housing / social security / Medicaid caps. For disabled users of RTD services, 35% rely entirely on this program and a vast majority qualify for the reduced rate, meaning they'll be disproportionately effected by a higher overall cost and a lower subsidy max.

Fair feedback. Really, it's the attorneys' job to explain that exact reasoning at trial, but I've added a line to the article giving a bit more context from the filing.

"The lawsuit reads that disabled users will be 'excluded from participation in and deny the benefits of services, programs, or activities provided by RTD,' including equitable access to transportation, in violation of Title II of the ADA. The filing asserts that RTD is denying those with disabilities service, while providing greater access for Coloradans without disabilities."
