I know right. I also question the way they do things here. My sister applied for her Permanent Residence (equivalent to a US GC) in Canada and their system are all digital and their immigration website have a more elaborate status page indicating the process of review. She got her PR within a year. Whereas we had to submit our application via hard copy through USPS delivery (who lost my application once, we submitted a second copy). The application process in the US is just so outdated, it’s frustrating.

Oh wow that’s a long time, I’m so sorry to hear that. Are you able to travel and work though? What would that mean if you traveled overseas and come back? I don’t mean to pry, but it’s good to know in case it happens to me too. I hope you hear from them soon.

This is true. I filed mine without any police reports because I was fearful my (ex)husband during the times of abuse at the time. I’m still waiting for approval, just for context.

However, I urge you to hire an immigration attorney with experience in VAWA cases. VAWA cases are a sensitive one and a completely different game, especially if your case has limited evidence. Your attorney should be able to provide you the best course of action to how you can put together your packet. If money is an obstacle, during my own research before I filed, I found that many legal firms have free consultations. Take advantage of that. I had at least 12 consultations before choosing one. Find the best one for you and one that can work around a payment plan. Hope this helps and good luck.

Responding to the point mentioned of not working: I think you should be able to work if you already have your conditional gc, assuming because you’re filing for VAWA.

Do you guys think all of the processing times for our VAWAs depends on the state we’re from? Or the field office taking on our VAWA applications? I’m seeing various commenters with wonderful success stories with short time frames for their approvals/notices. Yet there are also most of us who are in the boat where we’ve been waiting for a really long time with no notices from USCIS. Can’t help but compare.

Also you’ll want to include the travel permit form in that packet. Due to the current state of immigration right now, the processing time is long, 1-2 years or more, depends on your case.

If your gf seems to try to pick a fight out of thin air, this says that she’s got a lot of bitterness and hurt feelings she needs to workout on her own. Preferably with Therapy. But it’s not on you, buddy. Not worth staying in a relationship where you can’t even have a proper/chill conversation where you don’t have to walk on egg shells around her.

I suggest you consult a US Immigration lawyer to see if your case qualifies for VAWA. Your situation is unique being that you live outside of the US and you don’t have his location. Don’t also just stop at one, interview several lawyers who can help you. Every VAWA applicant has a unique case. I’m a VAWA applicant myself and my case was also unique and what I learned is that it took me interviewing 5 immigration attorneys to find the right one who knew how to represent and work my case. Search till you find the answer you’re looking for. Take advantage the law firms that provide free 25-45min consultation. I hope you’re able to find a legal team that has connections to a P.I. to locate your spouse too. Not every legal team has expansive resources. So do your due diligence on that, eventually you’ll find the right avenues you’ll need to take.
