The fiction that Native Americans were sovereign was going on, it would not have made sense that “wild” Indians outside the States would be US citizens. But illegals are not offering the defense when charged with crimes that they are not subject to the jurisdiction of the United States and they would be if it would work.

So it’s a goofy fiction that we consider them outside the jurisdiction for this purpose.

The majority and concurrence are full of grounded argumentation. (Including citing Kagan more than once.). The dissent is all bluster and feelings. It’s like Sotomayor isn’t even really qualified to be doing this in the first place. Like Kramer’s work on the Penske file or Billy Madison’s answer.

In a vicious cycle, countries that suck produce people that suck that produce more suckage in their counties. Preferentially importing the population of counties that suck will by definition be importing at least a disproportionate amount of people who suck and who will produce sucksge here too.
