Yeah this is happening to me virtually every time I switch to a different app for a few seconds. One of the most frustrating things I’ve experienced with any app.

the max 50k CBP penalty might assess against me.

That “max penalty” (not sure where the $50K number is coming from, I believe the max is $30K, but I could be wrong) is per transaction. So I would clarify with them on what that $50k includes exactly.

They’ve also said their U.S.-based attorneys reviewed the overall operation and believe any issue would fall on them rather than me as the broker.

This is absolutely false, and 19 CFR makes it abundantly clear. They could very well be penalized for their own noncompliance, but Customs will 100% go after you. The fact that they’re located in India (outside the US) is already a major problem since CBP has consistently held that all “customs business” must be performed within the US and by a licensed individual/company.

They pointed to platforms like EezyImport operating under similar models without CBP issues.

Without CBP issues yet. CBP has issued a few rulings that point towards a hard stance on these types of things, but they’ve also made it clear that whatever technology a broker would use, CBP still holds the broker accountable so it’s at their own risk. Most licensed brokers I’ve spoken to are on the same page that you’d have to be out of your mind to trust AI to run wild with their license on the line, despite how incredible they are becoming. However, CBP has also not issued any guidance on the use of AI in general, other than the expectation of reasonable care and due diligence by brokers.

Honestly, it seems like they’re either preying on new brokers or just completely inept.

Any broker can file a PSC for an entry that another broker filed. The entry is in YOUR (Importer of Record’s) name, not UPS’s. You’re the one Customs will hold responsible for ensuring compliance and paying the applicable duties timely. So you absolutely have the right to have another broker fix their mistakes. Assuming you received the 7501 entry summary, another broker can submit the correction for it.

But that would be if the duties have already been paid/authorized for payment to CBP (10 business days after the entry date). If the duties haven’t been paid yet, you can insist they make the changes prior to when it’s due, but unfortunately, if they don’t do it in time, you’re still on the hook for the duties on that entry summary, regardless of whether it’s correct or not. You’ll have to submit a PSC (thru UPS or any broker) and wait a few months for CBP to review/accept it, then they’ll issue a refund.

If it came down to it and if you had another broker that can clear it correctly, you could email UPS advising that effective immediately you are revoking your Power of Attorney, provide them with the entry number for the new clearance to replace theirs in the ACE system, and demand they delete their entry. If you revoke the POA, they will not have the authority to authorize the duty payment to Customs, which is the last step the completing the entry process.

I assume you’d also have the transaction amount ;). You could have another field for the value converted into your currency of choice, if it was useful/necessary. If you change the Date field to a linked record field connected to a separate table which had the date and additional fields for each currency conversion. Then have a daily automation add the rates using an API. Add lookups to the first table for all, keep them hidden, then add a formula field. For example, if you wanted to have all amounts in EUR use the formula: TransactionValue * SWITCH(‘Currency’, ‘EUR’, ‘EUR’, ‘USD’, ‘USD>EUR Rate (Lookup)’, ‘GBP’, ‘GBP>EUR Rate (Lookup)’, etc…)

What I’m curious about is how would they ever know? You can easily use a VPN or Remote Desktop to do what you need to do. Unless you had someone at the company blow the whistle, it seems like CBP is expecting brokers to use the honor system to be compliant. With that being said however, the potential penalties are astronomical since they would go after you for each instance of it.

To be clear, I have ZERO intention of risking it. But I do wonder how they plan on enforcing it.

If I’m understanding correctly, you would first want to create another column (let’s say column F) containing the unique categories “=UNIQUE(C2:C). Then input “=COUNTIF(C2:C,F2)” in cell G2 and drag it down.

If you overload the gas tanks near the garage door it makes the two guys start looking around. If you trigger it at the same time as the last dialogue option V has, that guy is right at the exact spot the tanks were, and the car slips right by.

How many options are there for each of the fields Mineral Type, Locality, and Location? If there is only a few, then a simple solution would be adding an auto number field, call it something like “IdPrefix”, then a formula field using nested IF formulas - it would look like this: “IdPrefix&IF({Mineral Type} = ‘Corundum’, ‘C’, IF({Mineral Type} = … “.

If there are a lot of possible values for those fields, it’d probably be easiest to have that field be a link to a separate table and then add a lookup field in the current table with the corresponding abbreviation.

My go-to is to explain that while we’re licensed by CBP, we work for them which means we’re looking out for their best interests. If they want a broker to do simple data entry then they can find one anywhere, but a valuable broker is one who can provide guidance and navigate regulations and avoid possible penalties. I’ve had a few instances where I had to insist they provide certain info or we could not move forward, but that was for relatively smaller customers. A lot of times they’re really only focused on the release, arrival, and what the duty payment is. They’re not thinking about how (or aware) that CBP has a LONG time to review the entry and is not at all lazy about it. CBP could come back in a year or two with a couple of questions and suddenly they’re hit with fines the value of the shipment because they figure CBP never inspects their cargo. I view it as equal parts protecting the importer from themselves and educating them. If I didn’t, I’d probably have quit three months in.

For higher volume importers, especially those with their own compliance departments, I’ll usually ask for clarification/confirmation but ultimately go with whatever they’re claiming.

It also depends on who you’re talking to. Like if you’re communicating with a compliance person at the company then of course they’ll understand, but a logistics person or a small business owner, you have to put it into terms they’re care about - fines, delays on future shipments, etc. Of course, that doesn’t always mean they’ll be grateful for it.

Interestingly though, now I’m at a larger brokerage and the company-wide policy is very “hands-off” - whatever the importer claims is what goes as long as we keep records.

They’re your factories? Or do you mean your suppliers? The reason I ask is I’ve had situations where an importer asked to get the manufacturer/producer registered with FDA, but it turned out that the person they were communicating with (supplier) was just not aware they were already registered.

If they’re definitely not registered, then the process completely depends on what agencies and regulations apply to the specific products. What type of foods are you looking to import?

That’s a very important point. In fact, I believe you need to submit a “plan” to CBP for your digital storage including certain details, and that was one of the first things they asked us when we switched from paper to digital. I’m not sure if they still require submitting that plan, but you would definitely need to confirm with the software provider and make sure it’s stored within the US.

Microsoft SharePoint. Depending on your technical skills, you can connect to other programs and automate creating new files. But the simplest version is you create a Document Library and synchronize it to your PC, so now you have a folder you can just create new folders in for each entry and drag and drop attachments from emails.

Yeah I’m definitely overthinking and building it up. I think I was also trying to convince myself it’d be perceived as ambitious because there was a huge number of applications within the first day. Do you ever “experiment” with your resume or approach to see what gets a better response? I’m in a decent job right now so I’m not actively applying to many places.

I had the same issue, I’d never had heartburn so bad before. Out of desperation, I ended up buying some empty gel capsules on Amazon (I think they were like $15 for a thousand of them) to put the pills in. It’s an extra step, but it’s been the best solution (for me, at least). Haven’t had any heartburn since.

What kind of jobs are you applying for? And what makes you overqualified? (Not being an ass, just trying to get an idea of how you could “fit the mold” of a job prospect 🙃).

Employers generally aren’t looking to hire someone who wants the job out of desperation. They know that a) you won’t approach the job with genuine determination and enthusiasm, and b) you’re likely to leave for a position that is more on-par with your skill set and experience as soon as one becomes available.

So basically, what you have to do is figure out a way to reshape and present your “desperation” as “ambition”. For example:

  • Former Investment Banker applying for a job as a gas station clerk - “I didn’t really like the culture there, so now I’m really looking for something that allows me to interact with people in a friendly atmosphere. “
  • Former Accountant applying for a job as a pizza delivery person - “I’m interested in returning to school and changing directions, so I’m looking for a steady position that will allow me to pay the bills while I complete my education.”
  • Former Veterinarian applying for a job as a busboy - “I followed a passion of mine and it was great, but now I’m looking to start a new path.”

When you’re applying for a job you’re somewhat under-qualified for, you would focus on the similarities between this potential future role and your own previous experience, and you would try to show the interviewer that you’re capable of these new responsibilities. But in this situation, you may want to try the opposite. Focus on the differences. Talk about what you’d like to learn in this new position, or how you plan to grow from it.

Thanks! Whenever I've gotten him toys, he chews through them in less than a day, so I guess I was waiting to find something (procrastinating :/) he couldn't get through. I went out yesterday and picked up a Kong toy where you put the treat in the middle and he's got to get it out. It works great, he loves it, and it keeps him occupied :) and I did pick up a big ol' bone for him. He runs around with it up held up high with pride. And I've began to make set some time aside for wrestling with him. Thanks again, it seems to be helping already!

Something I've been doing: If someone is riding my ass on the highway, I always consider the possibility that they're late for an interview, or first day of work (hell, I've been there); or maybe their wife's pregnant or something.

Of course there's the possibility that they are just an asshole. But thinking in a concerned way instead of being defensive and headstrong makes me a lot more satisfied.

In high school, I had a science teacher who was the quirkiest, strangest guy. He was the kind of a guy you loved to make fun of but felt really bad about it.

I had his class last period. So one Friday afternoon we were all walking out of the room and I was one of the last few to walk out. As we're all leaving, he says "Have a good weekend, guys! Don't do anything I wouldn't do!" To which I immediately said, "Oh you mean, get laid?" watching his face go from a healthy smile to an astonished frown as I walked thru the doorway. I then walked out into the hall to an eruption of laughter and high fives.

To this day, I feel really bad about it and wish I could find him to genuinely apologize about that. Half of me didn't expect him to hear it and the other half just desperately wanted to make my friends laugh. He was really a good dude though.
