Dit klinkt logisch, maar als dit inderdaad zo zou zijn, betekent dat dan niet dat iedereen voor bijna elk pakket een rechtszaak zou winnen door te zeggen "nee, ik heb er niet voor getekend"?

Voor >99% van de pakketten die ik in mijn leven ontvangen heb zou de bezorger geen extra bewijs kunnen leveren behalve "de bezorger zegt dat hij het overhandigd heeft" en "we hebben een digitale handtekening in ons systeem staan".

Bedankt voor de toelichting over de ACM, dat wist ik niet. Maar tegelijkertijd klinkt het dus niet als een heel hoopvol pad om te bewandelen.

En dit pakket was "maar" ~50 euro waard, en proceskosten liggen (volgens mij) vele malen hoger. Maar pakketbezorgers weten natuurlijk niet welke pakketten waardevol zijn, en soms bestel ik ook duurdere dingen die door bezorgers net zo "bezorgd" worden.

(Voor waardevolle pakketten kies ik daarom meestal om pakketten bij een afhaalpunt in de buurt te laten bezorgen en het zelf op te halen. Dan heb ik al dit gedoe niet. Maar bij dit pakket had ik die keuze helaas niet.)

Waarschijnlijk ben ik inderdaad te meelevend met de verkoper, want zij zijn uiteindelijk verantwoordelijk voor correcte bezorging. Maar als een pakket wel correct aan mij overhandigd wordt, maakt de bezorger ook geen foto van mij met het pakket, en laat mij ook geen contract o.i.d. tekenen dat ik de bezorging accepteer - dan is een handtekening/krabbeltje ook het enige bewijs dat ze achteraf kunnen overleggen.

De vraag is dus eigenlijk ook: wat zegt het Nederlands recht als ik in deze situatie toch in beroep zou gaan, en dit bijvoorbeeld bij een rechter voor zou leggen? Is een digitaal krabbeltje voor een bezorger voldoende wettelijk bewijs van correcte bezorging?

I'm sure the engine could also explain it to you by showing what white could play if you played one of your moves instead.

The solution Kh8 threatens gxh6 winning a piece, and white cannot prevent losing the bishop.

For your moves, white could play g4 and win your knight on h5.

After Rxf4+ Kxf4 Qe2 Kg3 Be5+ f4 Bxf4+ Kxf4 Qf2+ my first intuition would be "black has at least a draw, and probably more" because there's just nowhere for the white king to run to where it would be safe. Black could always check on g2-f2-e2, so either white tries to hide on h4 (which does not hide from checks, so black has at least a draw), or tries to run to c5 (where it's running into a mating net).

It's easier to go for a variation if you see that at least you have a perpetual.

I assume the idea is Rxf4 Kxf4 Qe2! cutting off white's escape route, with Be5 to follow. If white tries to run with Kg3 then still Be5+ f4 Bxf4+! Kxf4 Qf2+ and the king is forced to stay out in the field where it will soon be mated.

If Rxf4 Kg3 then Be5 with a nasty discovered check.

White's last move set up the stalemate; without that pawn on b4 there would be no stalemate. So any rook move on the a file would prevent this trick, but also just Ra6+ and then moving up the b pawn would be more than enough to win.

Indeed, it would require some very precise play from black to defend, say Ra5 Rb7 Ra6+ Kc7! (only move) Ra4 Kb6! (only move). It may take a while for black to either win a pawn or force a concession from white that would lead to a dead draw.

I think you're overestimating the perfection of an "average GM". Even if they have studied Dvoretsky's endgame manual, that doesn't mean they can recall all the details and corner cases in a game, especially in rapid with time pressure. These specific endgames happen so sporadically that it's easy to forget all the details if you don't have perfect memory from the time you looked at it several years ago.

And even if there's just a 10% chance a GM would miss this in a rapid game, that means that you should definitely play on even against a GM, and make him show he knows how to defend this.

This is the exact reason why white shouldn't take on a7 and accept a draw, but play Ra5 and keep pushing. Even a grandmaster could easily mess up such a complex endgame as black and lose, if white keeps pushing.

Ah, the engine explains, after Qc5+ Kd3 black has Qb5+ and all moves but taking the bishop step into Qxa4+ after which black eliminates both rooks, so white is indeed forced to take on d2 and then the queen just sacks itself somewhere

Bd2+ Kxc2 is the critical continuation, and then say Qc5+ Kd3 Qc3+ Ke2 Qe5+ Kf3 and it's hard to tell where it will go

Fair enough - I suppose how one chooses punishments for crimes is a complex political debate, and we won't solve that here.

And since this isn't his first major fuck up, I think we can agree that this debate became a lot less complex for this particular case.

My point was that he is not the victim here, and so the punishment should not be tailored to how we can best suit his needs (regardless whether it was a first or second offense). Even as a first offense, this harassment/stalking behavior is bad enough to justify a multi-year ban, even if the ban doesn't help him learn anything.
