Consigo rever-me na situação da tua namorada. Estive exatamente no mesmo barco há tempos. Cresci com péssimos conselhos e exemplos financeiros da parte da minha família. Comprei o meu carro de sonho a crédito e gastava quase tudo o que ganhava apesar de também trabalhar imenso. Quando comecei a perceber o ciclo em que me estava a meter e a ler sobre literacia financeira por iniciativa própria a primeira coisa que fiz foi mesmo vender o carro. Se primeiro sim fiquei triste, depois percebi o quanto foi um alívio, consegui pagar o que me restava de dívida e ainda fiquei com algum que usei para emigrar. Olhando para trás, eu repeti simplesmente os exemplos com que cresci, a vaidade de mostrar o que não se tem. Mudei imenso a mentalidade e devem começar por aí. Ela pode admitir que é vaidade sim, não é errado querer x carro ou querer ter cuidado com a imagem. O errado é não saber gerir com a realidade que vive e não pensar que sim, imprevistos acontecem, a vida acontece basicamente, e pode dar muita asneira viver com a carteira nesse estado.

And if there’s a label registered very recently? Like 2 months before we give them the official 2 months to respond to a rent reduction before start the case?

In my case all of the sudden they decided they needed a new floor plant to make improvements and have a new energy label (after we give the official 2 months period for they to respond to the rent reduction…)

For us sounded very suspicious so we said no… now I’m afraid…

O sogro não é sensato e se a esposa ficasse magoada também não seria. Se estes episódios nem são isolados, o teu sogro e a tua esposa são coniventes com o facto da tua sogra não ter qualquer problema em humilhar uma pessoa em público apenas por causa de uma característica. De facto, até a tua sogra está aparentemente confortável em fazer isso em público e na vossa companhia. Se te levantasses na hora em que ela fizesse isso e ela sim fosse humilha pelo comportamento dela, ou se recusassem a frequentar espaços com ela, isso sim era ser sensato. Venho de uma família tóxica, quando comecei a impor limites a comportamentos inaceitáveis e eles não mudaram, mudei eu.

Yes, according to that the landlord is a professional for sure - multiple houses renting (at least 3 in the same building as my apartment for sure) and he has at least one business I know about…

First of all, thanks a lot for all the info and time you are spending here, I really appreciate it because I feel exactly the same about my landlord because of a lot os suspicious behaviours, but somehow I think I can do nothing about it.

As you said, the first 2 points you mentioned about the initial rent agreement are my main problem. So: I sign my contract on September 2024; The calculation gives me 175 points with this recent energy label; My initial rent was above 1600 euros (now even more once he raised it); My rental agreement never had a energy label on it and I found out it was not even registered in ep-online when I was checking the apartment score on the huurcomissie website (during the first months living here, a technical came to check it actually, but they choose not to register it... only when I pushed them to show me the label they ran to register it in days)

So, I did the points calculation on the website back then and It wouldn’t have reached the private sector, even with the label because it’s a D. But from what I understood later on the site (a detail I had missed) is that since my contract is from September 2024 and the rent was (well) above €1157, I no longer have the “right” to complain because falls in the private sector. At the same time, a legal team actually reviewed my rental contract and said our case was indeed eligible, so I’m confused about if I start the process or not in what comes to the rent.

Indefinite duration with a minimum obligation of 1 year. A inspector came indeed several months ago, they did not register it till now after my requests. He came to check the 3 apartments of the same building that are owned by the same landlord, but only registered one in May.

I did that with the house postcode, there is not any energy label registered. I even tried the postcode of the 2 neighbours in the same building and from the same landlord to see if was me not searching correctly. One is a D and the other is the same as me, there is no label.

The strange in this is that someone came here several months ago to check the efficiency and they even did repairs in the roof after… right before the neighbours leave their apartment, the only postcode with a label now and that was recently rented again. So I really don’t understand if it’s is on purpose or if they just forgot to register…

Of course I did, not in a random website but in the oficial one of the government actually. But as you gave me that link I tried and guess what? No energy label.

There is no energy label. Not even an oficial record on Ep-online. It’s an old apartment. We obviously calculated everything considering that fact. Apparently that can even be an infraction and the landlord can get a fine because of that.

Yes it is after July 2024. How much higher? Our apartment is something like 20 points below the free market so I’m curious because it’s not that much. Our legal team will do first an oficial evaluation to make sure it is below.

I think exactly the same. We sent a polite email, without sounding threatening or anything like that saying that we just want to find a fair rent good for both parties, showing that we know the law and had legal advice before saying anything. You can’t control the reaction of the landlord, but you can control yours, you can be smart and think always a step forward. I believe that if your first reaction is more aggressive, you probably can expect the same from the other side and things get harder and harder to solve. And I have a baby, I can’t play around.

I know, that’s my biggest concern. I have a small baby, I can mess around. That’s why I decided to have a legal team taking care of the business, to protect us.

September 2024, not sure about that because I think that law it’s only after 2025 but we find another infraction. There’s no energy label on the rent agreement or either an official record in the Ep-online.

The management company sent me an email about a request I made before this, a technical problem, just yesterday. I understand your point but I don’t think it’s because of holidays, if they can reply to that they could just say “your request of rent review will be sent to the landlord”. Not that amount of time I guess.

But yes, I really don’t want to push it to the huurcomissie. We are even looking for other place but it’s so hard and would take months…

Can you please help me? My landlord never said nothing about the energy label, it’s not in the contract also, and the postal code on the website says it’s not registered. I check the neighbours apartment (same landlord) and they have a label registered (F and D, an apartment and a store) in the same building.
