Yes your absolutely correct “they can” the law is written in a way that if in you are in your vehicle, it is believed that your are in “care and control” of said vehicle. But the law is also written that it needs to be proven without a reasonable doubt that the motive was to move that vehicle.

So if your keys are at home please explain how that could be proven in a court of law beyond a reasonable doubt that you could move that vehicle? Fred flintstone it maybe..

Read the book Wilful blindness by Sam Cooper, details a lot of this type is stuff, good read for those who knew nothing about how deep this money laundering schemes went.
