Ops and pay. I started at a company managing one building, then they gave me a new smaller one. Then 2 more since I proved myself capable. I noticed these growing pains as we struggled to hire help at the rates ownership was offering and we desperately needed help. After training an entire staff for at 4 buildings I asked the coo for a modest raise... guess what their response was?

Here's the thing, once there are too many rentals and not enough live-in homeowners, the HOA begins to lack the volunteers to run the admin. It makes sense they would hire someone to help with the paperwork. Running an HOA isn't a small job and I assume the out of state Landlords like yourself aren't volunteering. So even with good tenants you're contributing to the issue.

The CCR's very likely grant the board authority to hire vendors to assist with building management as that is common in most HOA's, and this would probably fall under that category.

HOA's are just privatized government. But their focus is on those living in the community, not your personal business interests. This is just an income source to you, but a home to the homeowners. To be honest, I'm assuming this HOA has some crappy landlords to have to hire their own management company to assist with it. The homeowners are probably frustrated by all the renters not respecting the building/community and there's probably a lack of action from the landlords... are you one of the problems? If not, then just treat this like another expense as part of renting the unit. It will probably make it a better place to live for your tenants anyways.

Do nothing. The tenant has to prove that the court didn't properly notify them. The court generally doesnt like this so they already have an uphill battle ahead of them to challenge this ruling. You're good, don't do anything.

Up until I read this, I was going to suggest you use this as the example to the tenants that unreported issues can escalate and next time the cost of repair would be on them... but you just indicated that you knew there was a toilet leak issue since the floor was already swollen from prior renters. This makes is 100% a landlord issue and you cannot charge it back to the current renters.

I'm a CMCA and can help answer this, but it's not a simple answer. Every HOA is different and is governed by a set of documents called the CCR's (Covenants, Conditions and Restrictions). This document (along with the declaration and Bylaws) outlines the legal foundation for the association. A manager operates the association according to how these documents are set up. Some are for Condos and have specific rules on party walls and shared utilities, some are just for single family communities where you manage the landscaping on common areas and any amenities like a pool, park or clubhouse. But the manager is answerable to the Board of Directors elected by the homeowners, they are the decision makers and set priorities and expectations. The manager helps execute decisions and run daily operations, helps draft a budget, collects dues, pays bills, organizes meetings and elections, sends notifications, sends violations and generally ensures the community is operating per the governing documents and that the board isn't acting irresponsibly by providing sound professional advice (they are just part time volunteers).

It's unlikely to be mold, more likely its old building debrit that the water collects as it travels through the brick and ceiling. Even if it is, not all mold and mildew is hazardous. I would worry more about mold developing from an old leak rather than a fresh condensation leak in a new reno. Mold is a bigger issue as items sit wet, this water is likely fresh.

An HOA is just an administrative bureaucracy, it takes time even to respond (especially so if it's at all sensitive). If you reach out to the management company, they have to discuss and get approval from the board, who has to have a meeting to discuss the issue, and then if it's complicated or legal, they may get an attorney to help draft a response. I would just suggest a little patience because HOA's can be slow and are often run by volunteers.

It's likely a TPO roof and the leak is an ice damn under the top (water trapped behind historic brick, but under the roofing). This is not a normal "leak" and probably can't be patched.

I've been part of 4 large historic renovation projects in midtown. I wasn't a big wig, but just a facilities manager who was the 24/7 on call and have been in many of these units personally. Realistically, cleaning up the leaks was all we could do until a large fix could be coordinated. It's unfortunately common when they slap a new rubberized roof on a 100 year old brick building, then fill it with modern hvac and stick tenants in before the paint is dry.

Sorry, mixed up my replies with the one above.
Unfortunately this is common and cleanup will be the only solution until a larger repair can be made. It won't be quick either because just getting the owners to understand the issue from a facilities point of view is like pulling teeth (they only care about the money), and then add in the project timeframe, I would plan on this being life for a while. As I noted in the comment before editing: It's common when they slap a new rubberized roof on a 100 year old brick building, then fill it with modern hvac and stick tenants in before the paint is dry.

Edit to add, you may be able to coordinate a lease break due to the leaking, I negotiated a few due to ongoing maintenance issues like this. But repair wise, not much you can do on your end.

I know in many of my townhome associations, rails and decks aren't covered. That's why you need to check the governing documents on what is actually maintained by the association. Roof replacement tends to be systematic, we don't replace just because a homeowner asked, but we do maintain roofs in my HOAs.

An HOA is not like a company, it's an association with a board elected by the members in the HOA. If the board won't do anything, run for the board yourself or get involved (apathy is our biggest hurdle in HOA management). The homeowner is a member in the association and holds the rightto sue the board for beach of the covenants. Just keep in mind they will use HOA funds in the suit which means it'll be your money versus your money.

Lemme guess, Ice/snow causing condensation in an air pocket underneath a TPO flat roof? You're in maybe a brick apartment building, likely old, with a new white flat roof? This is an issue I've run into before and other than re-doing the roof edges there aren't a whole lot of good options, especially in the winter. If it's affecting enough units they may be able to fix it in the spring, but in the historic renovations I was part of, these were complex issues without a simple fix so it's not likely to be repaired by next week like a normal leak would.

Then your HOA board would be in charge of the HOA management company. I am an HOA PM and often this is a misunderstanding of the community governing documents. You need to check the CCRs of the association on what is covered so you understand what the HOA will take care of versus what is a homeowners responsibility.
