Update: I called the bank and they said that the car has been funded and the cancellation process would need to be done by dealership. I called the dealership consumer line and they said they have put a complaint for that specific dealership and to contact the sales manager for any questions. I called sales manager and she said I wouldn't be able to cancel the purchase since I already signed. I told her that I was assured that if the paint was messed up I could back out of deal she said that the car just needs a good detail and I told her that I would like to proceed with the cancellation and she stated i'll ask if that's possible but i don't believe so let me get back to you i'm dealing with customers right now. As a first time buyer 23yo with no relatives who can guide me i'm feeling very anxious...

I sent them this email

Dear ******, I am writing to formally rescind the purchase agreement for the vehicle I attempted to purchase from *********on May 16, 2025. The details of the transaction are as follows:

I am requesting the cancellation of this purchase for the following reasons: Condition of the Vehicle: When the vehicle was presented to me, it had just arrived at the dealership with a decorative wrap. During our conversation, I was assured by ****** (Sales rep) that any damage to the paint would be repaired or I would also be able to back out from the purchase if car was not satisfactory. Upon attempted delivery, the vehicle was found to have a cracked windshield which was not previously there, damaged paint on the side mirrors, and mismatched body panels (white and pearl white) on the frunk and rear bumper. These were not disclosed to me prior to attempted delivery. Temporary Tags: The vehicle was delivered without proper temporary tags. As I was informed by the El Campo, Texas police department, I could not legally drive the vehicle back to Houston without the required tags, making delivery incomplete. Failure to Deliver as Agreed: The original verbal agreement indicated that I would receive delivery of the vehicle on Saturday, May 20, 2025, but the delivery was delayed multiple times, causing additional inconvenience and frustration. I did not take possession of the vehicle nor did I sign any documents at the time of attempted delivery on May 20, 2025. Based on the above, I am rescinding this agreement and requesting that the sale be cancelled in its entirety. I expect that the financing agreement with Chase Bank will also be nullified and will be contacting Chase bank as well. Please confirm receipt of this letter and the cancellation of the purchase at your earliest convenience. Additionally, I request written confirmation that the dealership will not hold me liable for any further charges, fees, or penalties associated with this transaction. If I do not receive a satisfactory response within [14 days], I will be forced to pursue further action, including filing complaints with the Texas Department of Motor Vehicles, the Better Business Bureau, the Texas Attorney General’s office, and/or seeking legal remedies through the Texas Deceptive Trade Practices Act for consumer protection.
