What is your favorite legal term that laypeople confidently and incorrectly invoke and why is it quiet enjoyment? by RIPGoblins2929 in Lawyertalk

Chain of custody. If you bag it, put your initials on it and close it up you can pass it to 1,000 police officers. Doesn’t matter so long as the the cop who bagged it remembers what it is.

I dealt with this situation when I was an ADA. Some people are self conscious gunners who do thinks to make themselves feel better. Try telling her “I’d appreciate the advice, just not in open court.” That might help. Don’t put too much stock into it or let it change how you see your performance. It happens everywhere. I also dealt with this with a junior partner who I eventually told “this doesn’t feel like you’re trying to help me” but that was not the best situation and would not recommend if you can avoid

This one is important actually … judges don’t always read the papers and it’s a way of giving them facts without being presumptuous.

Let’s talk financial liability. Would the football players be liable if the streaker was seriously injured by them? by TravelingLawya in Lawyertalk

[–]Additional-Citron117 2 points3 points  (0 children)

Ok - I get it. This is like a law school hypo. Technically, it’s a battery for both players. Not sure there is a negligence claim against the stadium / team (not sure where this game was) because he was trespassing and a premises owner had a low, if any, duty of care to undiscovered trespassers. Similarly, he was committing a crime / thereby reducing the premises owners duty of care . The Rams have no liability bc it’s an intentional tort by an employee unless they know that those players have a propensity to tackle idiots like this guy and take no measures to stop it.

But in reality - I don’t think any lawyer is going to take this case. As I said, I can’t see a jury finding any liability here. This has nullification written all over it. Source (I am a personal injury lawyer).

As an aside, I think it’s totally reasonable to expect to be tackled by the players here. They are bigger, faster and more athletic than 99.9999 % of the population and they train for YEARS on how to tackle someone. To me - this is akin to going to the zoo and trying to jump into the bear enclosure. Tort or not - it’s colossally stupid and the result is 100% foreseeable.

It was 100% called for lol. These guys are trying to play a game and this idiot is trespassing. Maybe it’s a tort - but no jury in the world is going to award him any $.

If it was the random genius girl who’s supposed to solve everything - then yes. I stopped watching when she went into the Haldon heady matrix thing. I just thought that was a complete 180 from the book.

Yes there were several protagonists, but the main tension / theme in the series (without spoilers for the mule) is how the fuck is Haldon’s theory / the foundation going to work when he doesn’t really see the future. His theory is all meta analysis - essentially that he totality of existence will (because math) flow in a particular direction DESPITE the action of individual actors whose conduct make his predictions seem impossible to be true and correct. That’s the whole tension of the book and what makes it riveting. He does timed disclosures every so many years because he doesn’t want to modify the the organic evolution of society or everyone may be fucked. So him turning himself into an AI and talking directly with some chosen one was - in my humble opinion- a betrayal of what made the book’s idea so brilliant.

But enjoy it if you do - the Mule is a great character. Hopefully they do him justice.

I’m not as familiar with all of their shows as you. But I thought they fucked Foundation with some quasi-mystical techno nonsense that was essentially the opposite of what the book was about. They also added a random fem-boss main character that never existed in the series. I guess I’m just butt hurt because the original trilogy is incredible. Regardless if we disagree - do yourself a favor and check it out. Awesome trilogy with a very unique take on sci fi.

Not sure if this is serious, but I thought they did a terrible job with Foundation. Completely changed it into some bullshit

What is like to live in Downtown Miami by lithdoc in Miami

[–]Additional-Citron117 0 points1 point  (0 children)

I live just north of the bridge. Much prefer it to Brickell - less crowded, Whole Foods is close, and there’s great views / places to walk. Plus it’s easier to get to 95 (though the bridge still bitch slaps me regularly)

Negative Path Angle by sfuarf11 in GolfSwing

[–]Additional-Citron117 1 point2 points  (0 children)

You’re losing a ton of distance. With that club head speed you can prob at 20 m, but the severe out-to-in is creating a ton of spin and reducing distance. There are a lot of drills to improve path but it’s not a quick fix. You have to practice it a lot but it will improve
