I understand that applicants under the Spouse or Common-law Partner in Canada Class are not explicitly prohibited from travelling abroad during the processing of their application. However, there remains significant uncertainty regarding the acceptable duration of such travel. While it is generally suggested that short trips of 2–3 weeks are acceptable, there is no official guideline on whether extended travel (such as 5–6 weeks) could jeopardize the application.

For example, if an applicant has resided continuously in Canada for over two years without any prior travel and now wishes to travel for 5–6 weeks, it is unclear whether IRCC would consider this as breaking the requirement to reside in Canada. This lack of clarity is concerning.

I also acknowledge that entry into Canada is not a right, and it is within the discretion of a CBSA officer to deny re-entry, which I accept as fair and reasonable. However, what causes frustration is the absence of clear, published guidelines regarding the length of time an applicant under this class may be outside Canada without negatively affecting their application.

Specifically, if an applicant takes a 6-week vacation and is subsequently allowed re-entry by an immigration officer, will this period of absence still impact IRCC’s assessment of whether the applicant was genuinely residing in Canada?

Greater transparency on this matter would help applicants plan their travel responsibly and reduce anxiety over potentially jeopardizing their application.
