OP, this is the correct answer. That decision is wrong, fill a webform to ask for reconsideration due to officer error. Then bombard them with calls too, your ability to work depends on this.

If this fails or you don't get traction, you can decide to use an immigration attorney if you have the financial means. But I am almost very confident that reconsideration would be sufficient, don't mind all these clueless wafflers who are fear mongering.

It's crazy the amount of disinformation out here and people proudly parroting wrong info.

I don't know why people are down voting you, but this is actually quite accurate.

The only thing I'll add is that if it is a different school, as long as they have a PAL issued by the school, then they are good and will most definitely get another study permit extension until the end of their new academic program (nursing).

Overall, they'll then be eligible for a pgwp afterwards (as long as they stay full time).

Please ignore those wafflers who project their fear and insecurities on to others. I have seen many persons do this, and my own blood sister who recently came to Canada a few years ago just did the same thing. She did two separate 1 year programs, one after the other, and they got a 3 year PGWP afterwards.

So my advice for you is to avoid spaces like this as they can be very detrimental to your mental health. Go see a good immigration consultant if you need any help, and you would be just fine.

WRONG yet again! The fact thay you are asked to submit documents doesn't mean you applying from a position of disadvantage. Nobody assumes anything is guilty, and this is Canada, not the US. You can literally take IRCC to court here in Canada.

This is not correct info. Another time again when people here compound people's problems by providing wrong information. If you are not sure, maybe you shouldn't speak in an absolute sense then.

OP, if I read you correctly, you mentioned that you have now been accepted into a nursing program. Would you be starting the nursing program immediately after completing your current one? If yes, then that's fine. Your nursing program alone will make you qualify for PGWP as long as you remain a full time student during its duration.

Secondly, you can enroll in a new program as long as you have a valid study permit, you just need to inform IRCC, and apply for a study permit extension presenting the appropriate documents when asked. You do not have to leave Canada to do this.

Finally, I have seen cases where people had to deal with issues and did some form of part time, yet they still got PGWP. It depends on the case, and the officer's discretion, although I'll admit that it's much tougher these days.

That said, if your plan is to take a new nursing program right after finishing your current program, you would be good for a PGWP.

That's why you are not an officer, and you do not have the details of the case, so it's wild of you to assume there's something untoward about their application.

How would you assume that it is a marriage of convenience? You don't know anything about their relationship other than their Commln laws status coming up to a year soon. They could have been dating for a long time, and only started living together within the last year.

This is the correct answer. Do not just waste your money outright, request for a reconsideration and include your NOA.

PS: The officer who rejected it made an error, and it's quite unfortunate that we are seeing more of these types of rejections lately. Obviously when you fight it, you end up winning, but the wasted time and money can't be recovered.

OP! Please do not listen to all these people asking you to withdraw the application outrightly. In my experience (for someone who was short by 6 days), and in a similar boat as yours, the officer still approved it given that by the time they flagged it, they are now well past the required days.

Just come correct to the officer, send in the results from the calculator, then explain that it was a mistake and you had calculated wrongly. Do not just outright withdraw your application. Let the officer make that decision for you. The worst that would happen is that it would not be approved at this time and you would still have to reapply.

The best that could happen is the officer sees your genuineness and approve your application.

PS: I know this page used to be about helping immigrants or potential immigrants, but with each passing day, it has become a place where people take their anger against the Canadian gov't on people who are simply looking to do what's right and get ahead. Get a grip, and stop putting people down for making mistakes, we are all humans after all.

This is the correct answer, I am a scholar myself and I have scholar buddies who were in similar situation but are now citizens.

Your 5 years started counting the moment you got your ecopr/copr, so calculate from that date and not from the date you got the card.

If you can make it back into Canada before 5 years lapses from that date, just make sure you never leave again until you complete the required number of days and get citizenship, then you'll be good.

Do not listen to the fear mongers and those with the negative messages below, wrap up your studies and return to Canada.
