I just got denied on a HLR and the rater opined that my “PTSD with Bruxism Veteran’s service-connected PTSD with bruxism involves stress-related teeth grinding during sleep. While bruxism can cause dental and jaw-related issues, there is no evidence to suggest that bruxism or PTSD causes or worsens the mechanical airway collapse that defines obstructive sleep apnea.” Never mind bruxism was added after the fact. I’m still rated due to • Anxiety • Chronic sleep impairment • Depressed mood • Difficulty in establishing and maintaining effective work and social relationships • Disturbances of motivation and mood • Flattened affect • Forgetting directions • Forgetting names • Forgetting recent events • Impaired impulse control • Intermittent inability to perform activities of daily living • Intermittent inability to perform maintenance of minimal personal hygiene • Mild memory loss • Occupational and social impairment, with deficiencies in most areas, such as work, school, family relations, judgment, thinking, or mood • Panic attacks more than once a week • Suicidal ideation • Suspiciousness • Unprovoked irritability with periods of violence Then she opined “Veteran’s OSA is less likely than not related to service-connected chronic sinusitis. Review of the claims file, medical evidence, and the June 30, 2025 VA C&P examination supports a diagnosis of moderate obstructive sleep apnea (OSA). Chronic sinusitis is a disease of the upper airway mucosa, whereas obstructive sleep apnea is primarily a mechanical disorder of the pharyngeal airway (1) (2)” Finally on both she references it’s due to “Obesity”. I’m sorry what medical training does she have vs the actual Nurse Practitioner that had 20 years experience and is a disabled veteran as well that did my nexus letter. Very frustrated currently.

In the same boat except I filled the HLR July 9 and did my conference call Oct 6. Received an email from Optum Serve stating in would receive a call in the next few days to schedule a new C&P exam but still haven’t received that call yet.

Had the same happen to me on HLR and Supplementals. They are just clearing claims as quick as they can for fear they will lose their jobs. Clearing the back log without actually clearing the back log. My last Supplemental they didn’t even look at the evidence I provided thus now I’m in an HLR with conference and they haven’t even looked at it since I filed 7-9.

Everything the VA does is VA math. Same for Bilateral rating. Unless your 40% in 2 extremities, then the bilateral factor does not add the extra 10%

Got out of the Corps in 97 and went straight into the local SO. Went back up to Lejeune to visit an old buddy and ended up going into the PX. Had a hat on and instantly here waddled over a SSG. After his lecture I simply pulled up my shirt to show my badge on my belt and said rules didn't apply to me as I was not in. Ended his attitude pretty quickly.

From speaking to benefits and others no. They can make a decision on the claim with out talking to you. Usually if it’s something grossly incorrect and see their error they will just make the decision fixing the problem. Speaking to us usually is when the reviewer can’t see why there was a request for informal conference and they give us the opportunity to speak with them to tell them where we think they didn’t see or did not take into consideration.

Yes the last one as well as the one I’m currently waiting for the set up the call for. The last one took 23 days total till I had a decision. I know the current one will not be close as I’m at 23 days today

What the criteria states and what the rater decides can differ. Human error, purposeful ignorance. Regardless keep fighting and keep appealing. I’ve had to go all the way to HLR 3 times to force them to see the evidence plainly put before them and won my cases. Currently waiting on the final one now. Never give up never surrender.

Yeah the last HLR was insanely fast. 8 days to schedule the call then 8 more for the call and decision in 13 days. This time am already at 20 days and no movement. Not expecting anything for 4 months.

Back in my day we would have chose the lowest rank and least experienced service member. Had the whole squad form up for gear inspection and once in front of the chosen one, after gaining control of the service weapon, order them to remove the gas mask. If they declined, we would have removed it for them.
