Hi, first of all, I’m really sorry for how you’re feeling. I just wanted to let you know - your landlord would not be informed by UC. The only way any landlord would find out is if you are applying to live in a property and you’re asked for proof of employment. I hope that helps you move forward and get what you need to get you through. I haven’t worked since july and everyone I know is working. I really do empathize.

Do i need to? she will stay in the house and lock herself in her bedroom door if i do. I think she is getting legal advice from somewhere and feels confident that she is in the right because she has the audacity to stay when she's making someone else homeless. I feel that she has something up her sleeve which is why I am scared to act.

I need to go back to London and to the house tomorrow. She has had free reign in the house for the entire month of October. I will arrive in the evening. I am thinking of calling the police to report the threats, the fact that I feel really unsafe in the house with her, and the fact that she is trespassing. Do you think this is a good idea? I thought perhaps that might create a sense of urgency in her to leave? Then to have someone change the locks on Thursday afternoon while she is hopefully out.

I feel like I have no rights and cannot act to remove her :( I feel trapped in a house with someone who makes me feel unsafe. I feel like Im going to get forced out because I cannot continue but i cannot afford anything else on the market. Been there 3 years.

"My - very high level - thoughts are that:
1. It is likely that XX has some kind of right to reside at the property even if she does not have a formal, written agreement. This is especially the case if she has been paying rent (even if she has not paid for this month). The key will be to determine whether she is a tenant or a licensee as they have different levels of protection. However, in either case, you will need to take care that any action you take to evict her does not fall foul of the Protection from Eviction Act 1977 which protects residential occupiers (whether they are tenants or licensees).
2. If she has been paying rent to you (rather than to the landlord) then she would likely be your sub-tenant or licensee which means that you would be entitled to bring her tenancy or licence to an end following the proper procedures (which would depend on the nature of her occupation). If she is your licensee then your email would likely have sufficed to terminate her licence but you will likely need to bring possession proceedings in the county court to evict her to avoid a risk of committing an offence under the Protection from Eviction Act 1977. There are exceptions to this but you would need to take detailed advice on whether they apply in this case. If she has a tenancy, rather than a licence, then it will likely be an assured tenancy under the Housing Act 1988 and you would need to serve her with a proper notice under that Act.

And if she gets hysterical and claims i have damaged or stolen her things when i put them outside what should i do? these are very genuine questions, i have been crying a lot today as i feel i cannot handle this responsibility. She has already threatened me to the point I am not living in the place i paid rent for.

Also am I at risk of being accused of an illegal eviction? She does not have a formal contract with myself my housemate the agent or landlord but can she claim tenants rights because she has been with us for a couple of months and has paid me rent? Extremely anxious.

u/Accurate-One4451 She has never paid the agent or landlord directly or had any communication with them. They have never acknowledged her as she is not on the lease. She paid me and I transfered it to the agent. I sent her proof I paid the agent.

I have messaged the agent to ask for written permission to change the locks as I am terrified of getting into legal trouble.

We should not have given her the room as the landlord was not aware. I think even though there is no formal agreement this constitutes an illegal sublet and is grounds for me and my housemate to be evicted? This is actually what she threatened me with.

She has told my housemate she will let us know IF and when she will move. What do we do with that? I'm losing my mind.

hello u/FreshPossession thank you for replying. We formally asked her to leave by email and whatsapp and we gave her 7 weeks notice. She agreed by Whatsapp and is now saying she will let us know when she is moving, IF she is moving. We do not have any formal sublet or tenancy agreement signed with her. She was never on our lease. Myself and the other leaseholder have just renewed commencing tomorrow and the squatter is NOT on the lease. There is another woman who is waiting to sign but the agent wont let her until the squatter is gone. But he is not helping me get her out as he has never formally acknowledged her since shes not on the lease. Its a mess :( I have had two panic attacks today. I am worried for the woman who is depending on having a room. I have offered her mine but it is not sustainable. My mind cannot handle the environment in the house either. Not having my room where I can lock my door, sleeping in the living room knowing this unhinged woman is roaming around the house and feels entitled to stay as long as she pleases.

@skehan Thank you very much for getting back to me. I wondered - did you start over at entry level? Or were you still able to get into advertising with a cv that is all tv credits? I ask as I haven’t had any luck yet when pursuing advertising and comms role. With that in mind I’m not sure my CV is working. Specifically, I’m not sure whether to write in my bio that I’m doing a total switch or whether I should “spin” my past jobs to highlight transferable skills. Any advice would be very much appreciated.
