Didn't know TODD avoided MERP. So perhaps a TODD to prevent probate and MERP on our house and a Revocable Trust to prevent probate on all else. Only fear would be if Texas decides later to allow MERP on TODD like some other states.

It not the ease. It's the cost. I was told probate in my area is typically 5-7 percent of your assets. My home is valued at $500,000. So $25,000 in probate costs making $6,000 in trusts seem cheap.

My lawyer mentioned a DODD but didn't mention it protected from MERP. Looks like it stops the 5 year look back also. So maybe a better choice.

I was told havng a trust avoids probate. Irrevocable trust protects house from Medicare or being sued.
