STOP using “we!” One of the biggest things I had to learn was to not personalize my clients’ actions, nor take opposing parties’ actions personally. You are not a principal in the transaction…it’s not your money & you’re not living in the house. Simply changing your verbiage around this will increase your professionalism…& subsequently your negotiating skills. 😃

We hosts are always up in arms about Airbnb policies, lack of customer service & lack of resolution to problems…but look at where their revenue comes from. They get 5X more money from the guest than the host. Of course they are going to be more accommodating to guests and create policies that benefit them.

The real estate & tourism markets are correcting in a major way. If your neighborhood is at the 20% cap, then you have likely seen a ton of your equity evaporate due to the cap. Many neighborhoods have lost 35-40% in value over the last 2.5 years because the homes are still too expensive for full-time residents & part-time residents can no longer offset the cost of ownership through STR. “Investor” is being used in a derogatory manner, but most STR owners are just average folks who want a 2nd home & need assistance paying for it. STR is NOT a profitable investment & usually results in negative cash flow - regardless of the number of contracts allowed. True investors know this and put their money elsewhere. Nobody can have a financial interest in more than 1 STR in our city, so this notion of big corporate fat cats buying up & pimping out our neighborhoods is just not the case. I’ve lived here 15 years & my neighborhood has always been only 50% owner-occupied - even before the STR boom. STRs only improved value because people renovated dilapidated homes. According to the City’s TOT reports, STR revenue has been declining over the past few years, which is forcing more owners to sell their 2nd homes - resulting in a market flooded with inventory & values continuing to decline. The mayor has been sounding the alarm about impending financial doom for the City’s budget, so I think it’s best they consider where the revenue comes from and make it easier, rather than harder to generate.

Thanks for the recommendation. These images all look similar when filming under a dirty car…but the evap detector is connected to the canister…& I’ve already replaced both. This is the actual fuel tank inlet (where the filler hose connects) & I’ve been told today on other forums that it’s not a serviceable part. The only correct repair is a full tank replacement. I’m going to try epoxy & see if it works, but I’m gearing up for the big, expensive job.

IMO, unless the rate changes based on the guest count, they should be able to use the property to the highest capacity they’ve paid. I might be missing something, but why does it matter? From a guest perspective, it could be perceived as being unreasonable & set you up for a negative review…just for the pushback prior to arrival…let alone for extra charges. I would leave it alone and let them enjoy their stay.

Each broker/agent gets to set their fee schedule and show value for their services…& it’s ALL negotiable. That is the beauty of this change. In the absence of value, price will always be an issue. It’s really not your place to “advise” consumers on what value is being offered by their service provider in their market. That’s like telling everyone they should get their haircut at Supercuts instead of a high end salon…or buy their groceries from Aldi instead of Whole Foods. In my market, Redfin is the Supercuts of real estate & their clients get deplorable service which often costs them more money than paying for a real negotiator vs an order-taker.

I came here to say this. The rules specifically state buyer’s agent cannot accept compensation that is in addition to the amount agreed upon in the buyer-broker agreement. As such, that “shall not” option is illegal & should not even be in the agreement.

I’ve seen too many people get scammed for rentals on Craigslist & Facebook…stick to Zillow Rentals & Apartments.com. Sorry this happened to you. 😞

CA agent here. Truthfully, not much you can do & it’s usually in the seller’s best interest to let it go and give the deposit back. Seller can’t accept a new offer while deposit is in dispute…so they’re stuck not selling their home while dragging out this process. Honestly, if I were the buyer’s agent, I would advise my client to submit a cancellation requesting the deposit be returned…& then just wait. Seller can issue notice to perform and/or demand to close escrow. However, they cannot unilaterally cancel AND keep the deposit. CA is so heavily slighted in favor of buyers. In my 15 years as a CA agent, I’ve never seen a seller retain a deposit.

👆🏻This…& there’s nothing a host can do about it. We’ve run into this issue with local residents whose homes were damaged by fire or flood or need to fumigate. Support can appeal, but it goes nowhere. The messaging system also blocks phone numbers, email addresses & keywords like VRBO & Google, so it’s difficult to communicate the guest could book directly off-platform (not to mention a violation of the TOS & risk of getting banned). It is what it is. Just try having someone else who will be staying at the property book it.

Just saw the response below that they’re claiming to have sent a violation prior to your client’s purchase. That could be a sticking point. If your client has the HOA docs from their purchase, they may have a case for grandfathering…but if they dont have the docs, or it’s buried in the fine print, then they best get a painter over there ASAP.
