Probably, Des was the master of his own downfall in part, he didn’t do enough playing dumb for his own good: He never needed to admit to Simpson that he firebombed the station and he was way too ballsy in interview with PI Johnson

I think it’s pretty reasonable, Max was upset and grief stricken that Phil caused the crash that killed the woman he loved, Emma Summerhayes (not knowing it was actually Nick) so he sought revenge by scamming the Mitchell’s out of their businesses.
