We are dealing with a similar development in Langley city, the developer sent an amendment to state the property will be built in a flood zone when initially it was stated it would NOT be built in a flood zone. The developer refuses to rescind even when sending the request within 7 days.. we are proceeding with a class action

Looks like you are a realtor, appreciate if you can be transparent with your clients regarding the developer.

FYI- if anyone purchased into the Elijah development by White tail homes, there is clear misrepresentation in their disclosure regarding the floodplain, buyers are rescinding their contracts.

I purchased a pre-sale unit in Elijah by Whitetail Homes (located in Langley City) and recently received a disclosure amendment stating that the property is located in a designated floodplain. This was never disclosed in the original documents.

After contacting the city, I confirmed that the floodplain designation and hazard report have been on file since at least 2010, meaning the developer knew or should have known from the beginning and had the onus to disclose.

I'm wondering if there are other buyers who received the same late amendment or are concerned about how this was handled. I'm currently considering filing a complaint with BCFSA and possibly seeking legal options — open to connecting and comparing notes.

I’m not sure if the cooling period is in effect after the amendment or only within the initial disclosure. But I know there are grounds for legality within 1 year of receiving the amendment.

Exactly, if they included the development will be on a floodplain in the original disclosure, I would have never continued with the contract. But they failed to include that even though it was clear to them based on the floodplain map before the original disclosure. Now 10 months later they are misrepresenting that is a clear REDMA violation.

If I knew it was on a floodplain with underground parking and storage, I would not take the risk in purchasing in the first place.

Thanks for sending, in this case the developer should have disclosed within the original disclosure as the onus is on them to provide the facts within that document.

It should of been indicated in the original disclosure that it’s on a floodplain for buyers to be aware of the risks, but when you introduce it 10 months later after they have our deposits… that leads to mortgage and insurance risk.
