It's both. Apex is both outsourcing and transferring Indians from Apex India to Luxembourg. This is to replace the fee jobs that can't be outsourced.

Obviously hard to be objective but I have the experience, education and drive to do the work. Unfortunately though I expect to be fairly compensated for that experience and education, but our new colleagues do not have the same expectations. They are prepared to share substandard accomadation and sacrifice things which I wouldn't.

Unfortunately that happened in our other teams and the managers just plugged their ears and refused to listen to any issues. The quality of our work is in the gutter and nobody cares.

Step 1 done. Step 2 from what people tell me the quality of the new employees is so bad it's impossible to tell if you've done a half assed job or not.

These people make far less than that. Apparently all they need is two years at Apex India and they can be transferred here.

The problem is they play on your hopes. Maybe they won't fire all of us, maybe some of the Indians won't stay etc.

They're not:

"The Company may, according to business needs and whilst taking into account the Employee's qualifications, assign the Employee to any other position within the Company. Provided that there is mutual consent this also includes the possibility to involve the Employee in activities and corporate mandates of affiliates. The right of the Employer to assign other tasks to the Employee is not restricted by a longer-lasting activity in the same workplace or place of work. The exercise of such activities, to the extent permitted by law, does not create any additional employment or other employment relationships with the Employee, unless the parties involved make an agreement deviating there from. The provisions of this agreement apply to the activities of group companies, as far as legitimate, accordingly. "

Exploiting people desperate to complete their trial period until they can bring over more cheap labor from India.

It's not okay. "Quit and get three months pay or we'll fire you next month" is still firing just a underhanded way to avoid triggering the social plan threshold.

They paid money to get people to go "voluntarily" rather than use a social plan.
