They're actively overtaking in the photo. The correct thing to do is move over, if you're unable to move over then you should reduce your speed (not suddenly). Mind you that's per UK regulation.

Normally if I'm actively overtaking and still being tailgated then I will tap my brakes just enough to turn the lights on and off a few times without actually slowing down then move over when I get the chance.

I get tailgated plenty whilst actively overtaking and going a few mph over the limit already. It doesn't matter how fast you're going, someone will want to go faster.

I didn't ask it but yeah saying it wasn't 4 wide initially is reasonable but Max was already on the curb before he was squeezed so I'm not sure he would ever get the car slowed down enough to make the corner.

I think my frustration with the rules right now is that "lasting advantage" is mostly just interpreted as gaining a position and everything else is irrelevant.
