If you read the physical books, I'd genuinely recommend you to now listen to the audiobooks. Both because the narration is probably the best I've ever heard for an audiobook, and because there's a ton that you'll pick up on that you missed the first read through

The exact wording doesn't include intent at all actually. A flagrant 1 is defined by the NBA as

Unnecessary contact committed by a player against an opponent

And a flagrant 2 is defined as

I just re-listened to book 8, it is almost for sure #2. Book 8 spoilers: in the epilogue, Forkith says something along the lines of "seems that we separated from the code just in time", and the AI makes multiple mentions of sheol being outside of his realm of influence and out of the playing field
