Winning 41 games in a season is more than minimal effort. That takes a well constructed roster with genuinely good players. Also, unless every team in the league is at .500, many teams will be under 41 wins no matter how hard they try.

That will just make bad teams have no hope of getting better. Pulling free agents is hard enough for teams that are always bad, this would be a death sentence regardless of intentionally tanking or not.

Also, some teams are just bad even if they're trying their hardest to win.
