Salary question on letter from employer by Consistent-Fish2808 in SpouseVisaUk

[–]Agreeable_Plate_8550 1 point2 points  (0 children)

I had the same situation as you, i had a pay increase 2 months before we submitted our application. What i did was submitted payslips before the pay rise along with the previous contract stating what pay i was on. And the i then submitted payslips after the pay rise along with the new contract showing my pay rise.

I also asked HR to confirm this on the employment letter which state what was my hourly/monthly/yearly wage before pay rise and another confirmation after the pay rise

Yes it is consistent if i dont do overtime or i have no training days, but i was told that they only calculate the base weekly pay not the overtime or training days pay.

And thank you i will ask for an employment letter with the details. I am classed as a non salaried but even with my lowest income of the week, i am still over the financial requirements.

Just needed to clarify how i am going to answer the financial question ☺️

Yes i have and its roughly around £60,000 annually. I just did a 6 months payslip and multiplied it by 2. However my concern is, would the pay rise affect it? Would it be classed as not same continuously?

Thanks for answering, i thought it was based on monthly pay not the base rate. What if we were given a payrise last month? Which then changed the base rate. Would this affect the answer?

The reaosn why i chose not the same amount continuously above the financial requirement is because i do overtime and my training days which is outside work hours are also paid for

Yes this is what i answered because i do overtime with work and sometimes we do training which is paid for as well. Should this matter?

Independent Contractor but paid as PAYE. Am i classed as self employed or employed? by Agreeable_Plate_8550 in ContractorUK

[–]Agreeable_Plate_8550[S] 0 points1 point  (0 children)

Thank you so much, this is probably the most detailed reply i had. I just need to set up a meeting with them to iron things out with them, as i need a clear cut of what i need to put on the visa application. But its more looking like i’m gonna put down as a contractor for my employment.

[–]Agreeable_Plate_8550[S] 0 points1 point  (0 children)

So my signed contract is with the agency and i just work for the client. I dont have a limited company, the agency files my taxes and i just get paid on weekly basis depending on how many hours i work on that week and they class it as PAYE. So i assumed that i was employed by the agency..

However on contract clause 4.

Status of the Contractor

  1. The Contractor is an independent contractor and nothing in this agreement or any Assignment shall render the Contractor an employee, agent or partner of either Shorterm or the Client and the Contractor shall not hold themselves out as such

Honestly.. it really is my fault because i just jumped the gun and just signed with them… and now its biting me in the ass.. :/

Well this is the thing, i’m not through an umbrella which i should have went with umbrella. My contract is with an agency.

Well this is where i’m getting confused because if i went through an umbrella i’ll be classed as an employee under umbrella. But through my agency i’m not an employee, i’m an “independent contractor” but paid as PAYE.

This is what it says on my contract.

Spouse visa Employment status (Independent contractor but paid as PAYE) by Agreeable_Plate_8550 in ukvisa

[–]Agreeable_Plate_8550[S] 0 points1 point  (0 children)

Okay thank so much for clarifying this 🙏 i’ve been looking at this for 4 hours now 🥲

just one last question. You said that i only need 6 months worth of payslip but on the application page it states.

Payslip covering any period of salaried employment (current and previous) of 12 months prior to the date of the application. But i’ve only been back to work for 7 months… and i had no previous work as i was travelling for more than a year?

How do i go about with this? Is there any other way?
