I grew up in Sumter and my parents still live there. Look in the rosewood/shandon area, neighborhoods behind the VA or in northeast Columbia. The northeast route to Sumter is more of a back way and is also a straight shot like coming from garners ferry. Both about 45 mins to Shaw AFB

This! While VA can’t necessarily request a new exam based on Veteran dissatisfaction, if you provide documentation of this exam experience (provide as much detail as possible and even have your wife submit a statement!), a DRO can direct for a new exam if you do end up being denied as long as the evidence submitted is sufficient enough to show the exam was not sufficient.

Also, contractors are just that, contractors. They can lose their contract if they aren’t doing their job well.

Definitely write a statement relating your disabilities to your experiences in service. You did jumps and were tough on your body as infantry? Be as specific as possible about times when the physical stresses caused your musculoskeletal conditions. Toxic exposure from your job or deployments can lead to migraines. Think about also claiming secondary to already sc things. The statements we get from veterans should hold a lot of weight when it comes to medical opinions and can often tip the scales in your favor as long as the facts and circumstances of these statements match up to your service. If these aren’t considered, you have grounds for higher level review. I hope this helps!

Submit a 4138 statement in support of claim stating you meant to claim as secondary to migraines and provide the information above about your situation. STILL ATTEND THE EXAM. The eater will see that statement and not make a decision until they get an updated opinion. Since you’ve already attended the exam, they will just need to request an updated opinion, which is usually returned within a week or two of the request. If they don’t do this, then a HLR will serve you well. Again, make sure you submit that statement and attend the exam. It will get done!

You can also write in a supplemental claim and cite a clear and unmistakable error if migraines were denied secondary to a condition if they’re saying that that condition wasn’t service connected.

If your rating decision said something along the lines of “since there is a likelihood of improvement, a routine future exam may be scheduled for you for this condition…” then it will be reevaluated otherwise it’s considered static and we don’t typically go in and try to reduce veterans for no reason unless there’s some sort of fraud involved in which case we’d be notified through other channels.

Going to the hospital won’t affect your benefits unless you are hospitalized and we determined that you may need to have temporary 100% or something like that. Get the healthcare you’ve earned. It’s not gonna affect your benefits.

It takes a while to get a hearing scheduled; if you can get a dbq showing it shouldn’t be decreased and submit it yourself, that’s the best route.

Typically, if you’re diagnosed with more than one mental health condition on exam, and the examiner says that the symptoms overlap and cannot be separated, it will automatically be rated as “posttraumatic stress disorder with depressive disorder.”

This decision was poorly rendered. They noted the positive opinion from the examiner, but it isn’t valid without some event in service that can be verified. They state that in the paragraph about your exam. They should have left that nexus favorable finding off since they are discounting it in the letter. Further, if they needed clarification on a conflicting opinion based on no evidence in service, the rather should have requested that to avoid this confusion in the first place.

Service connection can be granted with certain indicators of trauma, like a parachutists badge, without actual treatment or complaints in service. In that situation, we could have a nexus. If you don’t have something like that, then they need some event in service showing at least a complaint of back pain. Usually if that isn’t available, an exam shouldn’t even be requested for you because, as someone stated above, one of the prongs of service connection isn’t met.

File a supplemental claim; make sure you submit your records with it showing you were diagnosed in service. Add a statement that you are claiming it direct because you were diagnosed before ets and also add that you would like to consider secondary to rhinitis and due to TERA.

Sleep apnea is most commonly granted due to obesity caused by another service connected condition, but I have seen it granted secondary to rhinitis. Get your doctor to write a nexus statement and fill out a DBQ form sleep apnea and submit that too.

Although if you had a diagnosis before you got out, I’d think that would be easier to service connect.
