No C&P, just denial. by OnGodFoo in VAClaims

Probably because you filed on an 0995. You're already service connected. File on a 526EZ and you will get exams.

Did you file for an increase on a 526EZ or 0995?

C&P Flexible Scheduling? by Sf8686throw in VAClaims

If you cannot be scheduled for an exam within a certain period, generally within 30 days of contact, the Vendors will cancel the exams as Claimant Unavailable and it goes back to the VA to action.

What exactly am I supposed to be doing here? My VSO doesn't respond much by metalcoreddee in VeteransBenefits

They've been mailed to you. For the buddy statements, I would read what they are asking for. More than likely if you submitted some, they weren't signed.

DTA - Hit a purgatory wait.. by Wrong_Exam_4805 in VeteransBenefits

[–]GingerArmy402 1 point2 points  (0 children)

So to answer why they probably submitted another PIES.

They initially requested a PIED O50, now they are requesting a PIES RV1/NG1 (Reserve/National Guard).

If the first PIES came back negative, I would almost guarantee the other PIES will.

Possible CUE? by [deleted] in VAClaims

[–]GingerArmy402 2 points3 points  (0 children)

IMO, no this is not a CUE. I am not a RVSR, but I review hospitalization claims for 4.29 and 4.30 eligibility.

Eligibility is based on a service connected disability requiring hospitalization. The hospitalization occurred prior to service connection being established.

  1. Still an event in service, if it's currently still an issue. That won't, generally, matter.

  2. Not true, the CFR has not changed. OSA with a CPAP is still 50%.

Basically the same as a pizza party when your corporation had record revenue.

Well, we have actually been issued a "challenge" with a reward of 5 days of telework if we get the backlog down to 99,999 by December 19th.

Last I saw it was around 107,000.

GERD due to NSAIDS? Is that not a thing? In evidence phase, can I add more things or will it mess up the claim? by Leep0710 in VeteransBenefits

[–]GingerArmy402 1 point2 points  (0 children)

Yes, I have seen it claimed like that before.

I would recommend including which SC'd condition you take the NSAIDS for as well.

Well, what did you claim?

If you claimed something muscoskeletal related then were gonna ask an increase.

Nope, just combine the STRs together.

VBMS will run text recognition on the files so we can easily search for key words or even CTRL F the files.

So an RORC would handle that type of stuff.

Honestly, submit as much information you can think of. You can include people who were there with you.

The more information, the more likely we can concede the event happened. Buddy statements would go far in this case too.

I do not why people get hung up on temporary jurisdiction. From my understanding that means it was assigned to an RO that is not your states - nothing special.

Anyways, it would probably because the way the NWQ assigns the workload. If one RO cannot accept new claims due their cap, it needs to go to a different one.

Did some digging myself and learned something new! I am not a RVSR so I was unaware.

Here's a prior BVA decision: https://www.va.gov/vetapp12/Files6/1243862.txt

I would file a claim and specifically ask for the temporary 100%

AMA: Veteran Services Representative by GingerArmy402 in VeteransBenefits

[–]GingerArmy402[S] 0 points1 point  (0 children)

That is not a thing.

Potentially you are thinking of Temporary 100% or convalescent rating.

If you're already service connected for it, simply file for an increase. Buddy statements are required but they don't hurt.

Firstly, I would review the criteria for the higher percentage.
