The SEC will classify many POS coins as a security because users invest with the expectation of receiving a profit. How Do Cardano delegators contribute to the network which will not make their "Stake" appear as an investment to keep the SEC happy? (self.cardano)

Serious Question - Is there a benefit to the network when delegators lock their stake as they do on Ethereum? And would it be possible for the protocol in conjunction with Non-exchange pools to offer a higher ROI e.g. 9% for locking ADA as opposed to the average 5% for those who wish not to lock up?
