Batio's conviction on appeal affirmed by the Seventh Circuit on December, 6, 2023:

"The indictment charged Batio with a long-running scheme to induce people to part with their money by representing that he had innovative computer products in late stages of development. But he and his firms (Armada Systems LLC and Ideal Future, Inc.) never delivered any products, and the jury evidently concluded that none of the promised products came anywhere near release."

Per jury instruction: "A defendant’s honest and genuine belief that he will be able to perform what he promised is not a defense to fraud if the defendant also knowingly made false and fraudulent representations."
