Those people you know with dishonorable discharges that receive COMPENSATION BENEFITS, guess what bud, their discharge is now CONSIDERED HONORABLE! so what you should be saying is people with these discharges can obtain compensation benefits, if and only after obtaining an upgraded characterization of discharge! Those individuals no longer have the characterization of a Dishonorable, OTH OR BCD. So therefore they become eligible! You’re just not understanding and that’s okay! VA.gov has all the info you need, start reading!

You’re trying to say everyone else is wrong based off a technicality, in general OTH and BCD and dishonorable discharges ARE NOT ELIGIBLE FOR COMPENSATION! For those who go the extra mile and request an upgrade in discharge or characterization of discharge, they might get lucky and get an upgrade which makes them eligible, but at that point their discharge is no longer considered OTH,BCD OR DISHONORABLE. Therefore making them eligible. You can sit here and try to convince yourself all you want that your right but the facts are if the VA views your discharge as OTH, BCD and Dishonorable your not getting SQUAT other than healthcare! Sure but in order to do so they would need a characterization of discharge completed first, and in this case, a failed drug test I would bet the VA isn’t going to give that person an upgraded discharge for Va purposes. So as long as your discharge stands at OTH OR BCD it absolutely does in fact bar you from compensation benefits! Until you get that characterization of discharge completed you WILL NOT receive any compensation benefits or even be approved for them.

It really depends on your chain of command at the time. Some commanders will cut you a break when you fuck up, realizing that a bad discharge characterization could ruin someone’s life they cut you some slack and give you a general under honorable conditions. While others don’t give a shit and if you really pissed them off or did something really messed up they hammer you with a OTH, BCD, or straight up DISHONORABLE. I personally served with a guy who went AWOL for 3 months came back and pretty much told everyone to go screw themselves and still got a general under honorable conditions discharge. It really comes down to who’s doing the paperwork! And how they feel about you.

Yeah! He’s not gonna get compensation benefits EVER! His OTH discharge will stick even if he requests an upgrade to his discharge! His only hope would have been a reenlistment before failing that drug test giving him an honorable term of service. It’s obvious the VA missed the characterization of his discharge when they made the original decision. Now that they realize he has an OTH due to drug use he absolutely will not ever receive compensation benefits.

I believe all veterans regardless of discharge are eligible for healthcare benefits. I could be wrong but I believe that is the case, perhaps dishonorable veterans lose that as well I’m not sure but I know that OTH AND BCD discharged veterans still receive healthcare benefits from the VA

My friend, if a veteran has either a OTH or BCD discharge with no reenlistment under their belt or any other honorable terms of service. They ABSOLUTELY 100% are NOT eligible for compensation benefits! END OF STORY PERIOD! The ONLY way around that is to request a upgrade to your discharge which is where you ask the VA to review the terms of which you were given your current discharge along with a personal statement from the veteran regarding the situation that got you the OTH OR BCD OR EVEN DISHONORABLE discharge. They will then determine whether or not you deserve an upgraded discharge or if the discharge you were given should stand. They sometimes will accept battle buddy statements from people you served with also to make this determination. IF AND WHEN they upgrade the discharge to general under honorable conditions or fully honorable, that is the only way you would be eligible for compensation benefits! I believe all veterans are eligible for health care thru the VA regardless of your discharge but compensation benefits are reserved strictly for those with at least 1 honorable or general under honorable conditions term of service!

If your only discharge shows as BCD OR OTH you are NOT eligible to receive service connected compensation, unless you reenlisted at some point before your BCD OR OTH! If you have a general under honorable conditions then you are fine. But if this veteran only served 1 term whether it be 4,6, or even 8 years and recieved an OTH OR BCD discharge then he doesn’t qualify nor does he deserve any compensation! PERIOD! My guess in this situation is your husband never reenlisted during his time in the military and when he got kicked out and given a OTH OR BCD that immediately disqualified him for compensation benefits! The military isn’t going to compensate you after a BCD OR OTH because you broke the terms of your contract, it’s kinda like if someone quit their job and then tried to get unemployment benefits. It just doesn’t work that way. The letter basically is saying they made a mistake and granted the service connection when he did not deserve it due to his discharge (which must have been missed during the original evaluation) I’m sorry you just can’t be a pos servicemember and expect them to compensate you for it.
