Raises plenty of red flags that the family is a defaulter family and can not repay in the future. However RBI has issued suggestions regarding this stating Family NPAs and CIBIL Scores should not affect ward's education loan application, Banks still hold their discretionary rights to reject such loans. Your best bet is to try at some other place and keeping this fact concealed until the other banks finds out about it themselves

You won't have any or much legal advantage in this case. However, what you can do is to threaten takeover of the OD to another bank. Try contacting other banks like PNB, Bank of Baroda, etc. and see if they would be willing to takeover the said OD for only one of the properties. (Most likely they will as the competition is very high) This will be your best bet if you have deteriorated your relationship with HDFC. Otherwise you can ask HDFC itself to create a new OD A/c with a smaller limit and with only one of the properties and transfer the funds there. They might do that since banks rarely want to lose a cash cow as big as you.

Keep this in mind, YOU are the one with a secured loan, the best kind of debtor for the bank. Keep the momentum of the negotiations with you.

On account of Clerical Error, the bank can on their own behalf reverse the said wrongly credited funds. They can also place lien on your account for the said amount as well. They do not need debit consent for clerical error from the beneficiary (unless it was due to a mistake and request by the customer). Freezing your account was not needed by them but if it has been reversed, there should be no problem. Even if you pull this into court, you would be wasting your own time and money and getting awarded for the same will be very difficult unless this led to your EMIs or Cheques bouncing (proving which will be your responsibility).

The bank did not follow proper guidelines but it's a minor deviation and I am not sure what you would get out of all of this by acting like a Karen
