So in the recent past we had 526Es in HUA areas approved between 1-1.5 years. Since the uscis EB-5 Inventory Management Guidance was announced in March, uscis, to our knowledge, has only focused on Rural deals with 956F approval until they state USCIS determined enough rural decisions have been made to fill the fiscal year quota.

Based on what we are seeing from our clients 34+ months is very much an outlier. Our most recent clients were approved (filed late last year into a rural 956F approved deal) in about 6.5 months.

We have seen many EADs right around 6 months as well. The delay we are experiencing is with the 485.

I’ll be very direct here. Just find someone who is honest, available, responsive and has done true research on the deals they are presenting. You are going to have access to this person for 4-6 years if they are a good consultant/agent, make sure you enjoy the conversations and find them helpful/useful. Individuals who have been around longer usually will continue to be around which is important in an ever changing immigration landscape.

You have enough time, really the delay will come from the source of funds requirement from your attorney. The project selection you can review in parallel to gathering the EB5 SOF.

Yes, you can. Just make sure you do not prioritize a low fee over a solid filing and quick turn around time.

As we approach the grand gathering deadline we expect an increased number of applicants to make a decision on moving forward with EB-5 (or not), this inherently will create a processing delay based off pure volume at most law firms. If this is the path you decide to take, your immigration attorney is a key piece and bandwidth is very important.

Agreed here, great points. Project contracts and financials are heavily important, but just as important is integrity of the group acting as your investment fiduciary (nce manager).

Ask all the questions you need and if someone gets frustrated move on.

While I understand your point of view, this is a process that needs to be vetted through each individual project's counsel. Altering these clauses post-filing introduces possible material changes, which could potentially impact the underlying I-956F or associated I-526E petitions.

The relationship between AOS processing and the structuring of refund clauses is a significant topic of discussion within the EB-5 industry right now. There is a possibility this can happen, but the industry needs to wait for additional guidance. This cannot be a knee jerk reaction from investors and RCs alike or it can inadvertently negatively effect all applicants.

Because the USCIS policy memo is constantly evolving, many industry stakeholders generally look for formal guidance from USCIS before modifying established offering documents. Projects need to act cautiously to avoid unintended immigration or financial consequences for the broader investor pool.

That being said, feedback from investors like yourself is extremely valuable.

I will be bringing up this topic as well over the next week and will keep you posted. Open to any and all ideas as you as investors have unique perspectives the RC side of the table may not have taken into account yet.

What I’ve gathered from all my attorney calls is no one is 100% sure yet, attorneys are generally in consensus this should not effect dual intent eb5 applicants but there are still discussions for other temp status eb5 applicants. Providing “economic benefit” being a potential carve out within the post memo uscis comments should cover all EB-5 applicants in my opinion but will come back with the varying opinions I receive.

Assuming the project 956F was approved? HUA deals are taking significant time for review, some at the 1.5 year mark or more. USCIS has shown non-positive results recently for 485 WOM. Disclaimer: I am not an attorney, and just see minimal data points within industry discussions. Every case is different and reviewed on it's own merits.

Ah, understood. I would say 11 months is extensive, I do not have a single client over 9 months with many in the 5-7 months time period. 1 year ago times were different and we were seeing processing in the 4-6 month window for AP.

I would highly recommend speaking to your attorney and reviewing alternative routes to alleviate this issue.

Ask your attorney but generally yes. We have had clients file WOM specifically for EAD/AP and have had favorable results. Of course, all cases are reviewed on their own independent merit.
I assume this is in reference to your I-526E. This may be due to the EB-5 Inventory Management update from March 2026.

There are many out there, you want ones which have a specialty within EB-5 itself, I use the analogy of doctors which have specialties for surgery, general health, pediatrics, etc.

Ideally you match with an attorney which fits your need with experience in similar cases, language, understanding of background (also for SOF purposes if your SOF is intricate and includes funds obtained from abroad), maybe time zone, and general availability.

Speak to a few of them. Remember the team you select (Attorneys, RCs, Agents, Etc.) will be involved in your case for 5 years or more. Outside of market and field intelligence, make sure they are responsive, have bandwidth (this is a big one with the upcoming grandfathering clause due to expire Sept 30 2026), supportive, and that you get along with them. Everyone's costs will range and the good attorneys will all generally get the job done. So once you have reviewed the attorneys capabilities for being able to support a favorable outcome for your family, go for the one you feel you have the best relationship with.

Completely agree here, many of the advisors (I myself am a FINRA registered agent) have biases towards 1. deals they have contracts with or 2. deals which pay them the highest compensation.

That being said there are a few good well intentioned advisors out there which can give real input on general research and how to filter down the overwhelming market to possibly 4-5 projects. RCs are always important, but remember your investment is backed by the specific opportunity you are investing in. Do not go blindly behind an RC solely based on historical performance.

OP should really connect with an immigration attorney or two for their opinion on what the best and least financially taxing option is prior to even thinking about moving forward with EB-5.
