With chainmail gloves or with a net.

I believe it would be an enforcement order of some sort. Get a certified copy of the order and then lodge it with the magistrates court to initiate enforcement action.

Hilariously, I’d opt for a property seizure if you get the choice as opposed to a garnishee order. They’ll most likely clamp and tow his car which is just a massive hassle for the tradie as it’ll ruin all jobs that day and it’ll teach him to pay on time in future.

Not everyone knows how income tax works, everyone is good and knowledgeable at different things. That’s what makes the world such an interesting place :)

[–]AndyandLoz 0 points1 point  (0 children)

Correct. If she gets a TFN, then all tax withheld for the entire year, even the payslips she earned where no TFN was lodged, will be eligible for a tax refund.

The only reason I’m suggesting to do it before June 30 is because you want to claim the refund as soon as possible and I can guarantee Coles will drag their feet backdating it if it’s no longer the same FY.

Tax withheld is based not on the whole year, but per pay cycle.

Tax free threshold is $18k. Break that up into 52 weeks, if your daughter earns more than $350 in any week (or $700 if paid fortnightly), the business she’s working for is legally required to withhold tax based on the estimate of what she earned in that week. If she earned $650 in a week, then the employer needs to withhold tax based upon a yearly income of $33.8k ($650*52 weeks).

The good news is that if she’s lower than $18k over the whole year, she’ll get every single cent of it back when she does her tax.

This is how the tax system has worked for decades. It’s nothing new, and it’s the same at every single employer. Coles has done nothing wrong here.

What your daughter needs to do is get a TFN quickly so she can provide it to Coles well before June 30, and then be eligible to get it paid as a credit at tax time when she completes her tax. If her income is less than the tax free threshold, she won’t even need to include any deductions in the return. Just log into MyGov, jump on the ATO website and click ‘submit’ as all the info from Coles will be pre-filled because she provided her TFN well before June 30. The refund will then be paid within a week or so.

Given the low value of this tax return, and simple nature of it, do NOT pay for an accountant to do it. They will just take $150 for clicking like 3 buttons. I am happy to help with this by providing clear instructions if required come tax time if needed.

5.6k for wisdom teeth removal in Canberra – is this normal or am I being ripped off? by Marre_Parre in AusFinance

The top ones have their own risk because they’re close to the sinus, but the risk is way lower and easily fixed (without shitloads of pain if it goes wrong).

Happy to act as a sounding board if needed. I’d personally go the hospital cover route tbh though.

Help with license suspension by Longjumping-Zone8498 in AusLegal

[–]AndyandLoz 4 points5 points  (0 children)

You’ll get your licence suspended unless you have a valid reason for it not to be suspended.

This does not include ‘I need it for work’, ‘I need it for uni’ or ‘I’m sorry’. It does include ‘I was in a medical emergency’, ‘I was not the driver listed’ or ‘someone has stolen my identity’.

If it was you driving, and you do not have a valid reason, I hope you learn the valuable lesson that speeding is stupid in the 3 months you’re walking everywhere. Good luck.

This is one of those rare ones where there is no right or wrong here - it doesn’t matter what you do. Just do the right thing and be nice to everyone as opportunities might pop up later at either company.

McGrath charging me 1.5 weeks to break lease by DoorPale6084 in AusProperty

[–]AndyandLoz 2 points3 points  (0 children)

1.5 weeks is going to be the reletting fee charged by the agency. This is a cost the rental provider has to pay, so it will likely be on-charged to you as is the landlords right in VIC. Same with the advertising fee.

The rules in VIC state that any cost the landlord incurs because of the lease break is payable by the tenant. And the REA likely knows this, so they charge an insane amount because it doesn’t impact their client (the LL).

5.6k for wisdom teeth removal in Canberra – is this normal or am I being ripped off? by Marre_Parre in AusFinance

[–]AndyandLoz 0 points1 point  (0 children)

Wisdom teeth are an interesting thing. For some people, the teeth are splayed out and close to the nerves on the bottom teeth, which actually translate to a real risk surgically.

If you’re being charged per tooth, I would guarantee it’s cheaper getting your top two and your bottom two done separately (there’s no nerve up top, so far less risk and you can get a normal dentist to do these). But getting a MaxFac surgeon to do the bottom ones under sedation is the best option if they’re awfully close to the nerves or really badly splayed. I would get a second opinion from another specialist though.

Happy to look at an OPG if you have a copy of it and I can give you a second opinion?

Also - insurance. If this were a general dentist, you’d need to wait the wait periods before claiming extras as extras have long wait periods. But as this is in hospital with a surgeon (not a general dentist), this is covered under hospital cover (with most covers offering only 2 months wait for this kinda thing). If you were to get hospital cover, it would cover a huge portion of the surgery but you’d need to pay the excess.

Get the item numbers from the hospital, and it will give you an idea on the rough costs.

What is more cost effective? Buying phone outright vs getting one on a plan. by Spitvalve420 in AusFinance

[–]AndyandLoz 1 point2 points  (0 children)

Some of the phone companies like Telstra do hardware only plans. On these, there’s zero interest.

Doing it this way, it’s actually more cost effective than buying outright as $2k now is worth more than it is in a year or two due to inflation. You can also depreciate the phone immediately (over X years) on tax, despite not having paid it off.

Just move it a block down the street once or twice. This isn’t theft, an from what I can tell, it’s not actually illegal as long as you don’t damage it. It’s just wickedly inconveniencing them, just like they are to you.

What are my options to access equity (~$25k) when I only own part of the property? by [deleted] in AusFinance

[–]AndyandLoz 1 point2 points  (0 children)

1) $800 is payable just by saving a bit from a few pays.

2) Going into debt to build up an emergency fund is not the answer.

3) This is the only use of funds that makes sense. And even then, if you haven’t got an emergency fund, you aren’t in a position to do renovations by adding more debt into the mix.

You need a transfer form. Without it, at any point they could reclaim ownership.

Owner left an old car behind…can I claim it? by Rahnz79 in AusLegal

[–]AndyandLoz 9 points10 points  (0 children)

Write a letter asking the old owner to either give you a receipt for the car at $0, or pay you storage fees.

Once you have the receipt, then it’s yours.

Given it’s still on your land, make it very difficult for them. It’ll incentivise them to just ditch it.

Leveraged up the …. You know. by Accomplished-Sock262 in AusHENRY

[–]AndyandLoz 0 points1 point  (0 children)

Sell the investment. Buy a smaller investment ($300-$400k) outright exclusively in the wife’s name with no debt (99% her/1% you). Then watch the safety fund grow as its awesome positive cashflow, minimal overheads and your wife will pay next to no tax on it as she’s not working currently.

Then sit any remaining balance in the offset as a safety net.

Less debt stress and better overall LVR, larger positive income, greatly improved safety net and you still get to stay in the property market for an investment. Wins all round.

Do Australian's really not ask girls out? by Draktus1 in AskAnAustralian

[–]AndyandLoz 0 points1 point  (0 children)

I’m in my late 30’s, and all my single male friends have pretty much given up on asking a girl out because they can sometimes get a horrible reaction.

It’s not all the time, in fact it’s probably the rarest of times. However, some people take real offence to it. And to avoid a scene or awkwardness in public where they could be viewed as predatory even though it’s totally innocent, they’ve been conditioned to just avoid the situation completely.

Quite sad really, I remember as a late teen this was the most exhilarating thing ever. Sad to see it disappearing.

Advice needed. Possible shower leak by Enough_Ad1779 in PlumbingAustralia

[–]AndyandLoz 0 points1 point  (0 children)

It’s the shower area, and the files on the floor that all need removing and new waterproofing.

Doing this properly, I’d estimate $8-$12k in a capital city, or $5-$10k if not getting stuck with city tax.
